MahaRERA has announced the list of 88 projects that came to Maharera for canceling the registration of housing projects on the website. If anyone has objections related to these projects opportunity to register objections within 15 days.

The list includes 39 projects in Pune, 15 in Raigad, 8 in Thane, 4 in Mumbai city, 3 each in Sindhudurg, Palghar, 2 projects each in Nashik, Nagpur, Ch. Sambhajinagar, Satara, Mumbai suburbs and 1 project each in Kolhapur, Nanded, Latur, Ratnagiri and Dadra Nagar Haveli.

A policy decision was announced by the MahaRERA through a circular on February 10, 23 that the registration of non-viable housing projects can be canceled subject to certain conditions. According to this circular, so far proposals have been received from Maharera to cancel the registration of 88 projects from the state. Maharera has published this comprehensive list on its website and if anyone related to this project has objections to deregistration of this project, they should send their objections to secy@maharera.mahaonline.gov.in within 15 days.

Developers in many cases start construction, even register the project with MahaERA as per the rules. But due to certain reasons, these projects don’t commence. There are various reasons for them, including no sales, no funds, the project in certain cases is financially unviable, court cases are going on, family disputes, new government notification regarding planning and others.

Some developers have multiple phased projects with a single registration number. Some steps are completed. There are difficulties in completing some stages. Zero registration is required in the project which is to be canceled in the phase of such a project. Not only this, if cancellation of registration will have any effect on others in the overall project, the consent of 2/3 of the Allottees in that project is also required by MahaRERA.

Not only this, if the project for which cancellation of registration has been applied for, even if there is an insignificant amount of registration, the dues of those concerned have been paid. They have no objection to canceling the registration. Documentary evidence of such manner is essential to attach along with the deregistration application for scrutiny.

Even after this, if there is a complaint against the deregistration of a project, Maharera will first understand the complaint by sending a notice to the concerned developer as well. In this order issued by Maharera, it was also clarified that the terms and conditions imposed by the authority will remain binding on the developer.

These projects cannot be completed. Keeping such stuck projects registered with MahaRERA is not beneficial not only for the developers but also for anyone associated with the project. Keeping this fact in mind, MahaRERA has initiated the process of canceling the registration of such projects subject to certain conditions while fully protecting the consumer interest. Accordingly, objections have been invited from the concerned within 15 days.
