Several housing projects commence construction and even get registered with MahaRERA, as per the rules. But due to some reasons, these projects do not get completed, it could be zero registration, no funds, the project becomes financially unfeasible, ongoing court cases, family disputes, new government notification regarding planning and others.

Keeping such stalled projects registered with MahaRERA is not beneficial not only for the developers but also for anyone associated with the project. Keeping this fact in mind, MahaRERA has taken such a decision recently, under conditions like, zero booking (Zero Booking) registration of such projects subject to certain other conditions can be canceled by going through the prescribed process to fully protect the customer interest.

Of course, if there is a complaint against this, a decision will be taken only after listening to their views, MahaRERA has also clarified in the order issued in this regard.

In the order issued in this regard, Maharerane has clarified many matters. Some developers have multiple phased projects with a single registration number. Some phases are completed, there are difficulties in completing some stages. Zero registration is required in the project of which registration is to be cancelled.Not only this, if cancellation of registration will have effect on others in the overall project, the consent of 2/3rd of the residents (Allottees) of that project is required by MahaRERA.

Not only this, but if the project for which cancellation of registration has been applied for, even if there is an insignificant amount of registration, the dues of those concerned have been given. They have no objection to cancellation of registration. Documentary evidence of such manner is essential to attach along with the deregistration application for scrutiny.

Even after this, if there is a complaint against the deregistration of a project, MahaRERA will first understand the complaint by sending a notice to the concerned developer as well. In this order issued by MahaRERA, it is also clarified that the terms and conditions imposed by the authority will remain binding on the developer.
