<p>In a strongly worded judgment, the Bombay High Court has quashed the disqualification of an elected managing committee of a Borivali housing society and ordered the Maharashtra Government to conduct a probe against the Deputy Registrar for allegedly acting under political influence.</p>



<p>Justice Amit Borkar, in his order pronounced on 7 May 2026, allowed the writ petition filed by Vishal T. Lathia and other members of the Managing Committee of <strong>Nensey Cottage Co-operative Housing Society Ltd</strong>, located at Sant Dyaneshwar Marg, Borivali (East). The court set aside the orders passed by the Deputy Registrar, Co-operative Societies (R-North Ward), and the Divisional Joint Registrar, terming the action as a “colourable exercise of power” influenced by external political pressure.</p>



<h3 class="wp-block-heading">Background of the Dispute</h3>



<p>The controversy arose when the society, which had secured 85% member consent for redevelopment and appointed a developer, faced opposition from a section of members. These members, instead of approaching the appropriate forums, routed their grievances through a local Member of Legislative Council (MLC) belonging to the same political party as one of the complainants, Mr. Sudhir Hattangadi.</p>



<p>On 26 August 2025, the MLC wrote to the Deputy Registrar. On the <strong>same day</strong>, the Deputy Registrar issued a show cause notice. Subsequently, on 27 November 2025, the Deputy Registrar passed an order under Section 75(5) of the Maharashtra Co-operative Societies Act, 1960, disqualifying the managing committee members for two years (later reduced to six months), citing non-submission of Audit Rectification Reports for FY 2022-23 and 2023-24.</p>



<p>Later, on 20 January 2026, an Administrator was appointed under Section 77A(1)(b-1), and one of the complainants was made part of the board. The bank accounts of the society were also frozen.</p>



<h3 class="wp-block-heading">High Court’s Key Observations</h3>



<p>Justice Borkar observed that the petitioners had submitted clear documentary evidence — letters dated 25 September 2023 and 10 September 2024 with official acknowledgements from the Deputy Registrar’s office — proving that the audit rectification reports and accounts were duly submitted. However, both the Deputy Registrar and the Divisional Joint Registrar failed to consider this material and passed orders mechanically.</p>



<p>The court noted that the entire proceedings were triggered by a politically motivated complaint. Relying heavily on the Supreme Court’s judgment in <strong>State of M.P. vs. Sanjay Nagayach (2013)</strong>, Justice Borkar held that statutory authorities like the Registrar must function independently and cannot act under external pressure or political influence.</p>



<p>The judge remarked that the “chain of events” — complaint to the MLC, immediate letter from the MLC, and swift action by the Deputy Registrar on the same day — created a strong impression that the authority did not apply its mind independently. The court described this as a <strong>colourable exercise of power</strong>.</p>



<p>The appointment of the Administrator was also set aside as it was based on the flawed disqualification order. The court further criticised the use of the urgency proviso under Section 77A without recording valid reasons and noted the conflict of interest in appointing a complainant as part of the Administrator board.</p>



<h3 class="wp-block-heading">Relief Granted and Directions Issued</h3>



<p>The High Court passed the following directions:</p>



<ul class="wp-block-list">
<li>All impugned orders dated 27.11.2025, 20.01.2026, and 15.04.2026 stand quashed and set aside.</li>



<li>The disqualification of the petitioners is cancelled.</li>



<li>The original Managing Committee stands restored forthwith.</li>



<li>The Administrator must immediately hand over charge, records, and documents to the restored committee.</li>



<li>The society’s bank accounts shall be restored to the Managing Committee.</li>
</ul>



<p>In a significant direction, the court ordered the <strong>Secretary, Co-operation Department</strong>, to examine the conduct of the Deputy Registrar (who passed the original orders) and the Divisional Joint Registrar. The State Government has been directed to call for their explanations and decide on disciplinary action within <strong>three months</strong>. A compliance affidavit must be filed in the High Court.</p>



<p>The request for stay of the judgment made by Respondent No. 12 was rejected by the court.</p>



<h3 class="wp-block-heading">Significance of the Order</h3>



<p>This judgment sends a strong message against political interference in the functioning of cooperative housing societies, especially in redevelopment matters. It reiterates that democratically elected bodies cannot be removed casually on the basis of politically motivated complaints without independent application of mind by statutory authorities.</p>



<p>The matter has been listed for compliance on 10 August 2026.</p>

<h3 class="wp-block-heading"><strong>Jurisdictional Lockout Ends: All Six Mumbai Stamp Offices Now Open to Every Citizen</strong></h3>



<p>In a landmark decision set to bring significant convenience to millions of Mumbaikars, the Maharashtra Revenue and Forests Department has eliminated the jurisdictional restriction on document registration. Effective <strong>October 10th, 2025</strong>, citizens, businesses, and company owners across Mumbai city and its suburbs can now complete the document registration process (Adjudication of Documents) at <strong>any</strong> of the six designated stamp offices, irrespective of their residential or business location.</p>



<p>This crucial notification, issued by the Revenue and Forests Department, supersedes all earlier orders, granting Mumbaikars unprecedented flexibility in handling their vital paperwork.</p>



<h3 class="wp-block-heading"><strong>Goodbye to Jurisdiction Headaches</strong></h3>



<p>Until now, the process of registering documents—including property agreements, lease agreements, and inheritance deeds—was mandatorily confined to the specific stamp office under whose jurisdiction the citizen resided or the property was located. This often meant long travel times and queuing at a single, overburdened office.</p>



<p>The new policy removes this spatial barrier entirely. Mumbaikars are now free to choose from any of the following six offices appointed as Collectors for the Revenue Districts of Mumbai City and Mumbai Suburban:</p>

<h3 class="wp-block-heading"><strong>Convenience is Key: Shortening Queues, Saving Time</strong></h3>



<p>The primary benefit of this decision is the drastic reduction in time and effort spent by citizens. By being able to visit whichever office has the shortest queue, citizens can expedite the registration process for important transactions. This measure is expected to be a boon for prospective home buyers, property owners, and business entities dealing with real estate and legal documentation.</p>



<p>The Revenue Minister for the state of Maharashtra, Chandrsekhar Bawankule, highlighted the dual benefit of this forward-looking move.</p>

<p>The notification, signed by Satyanarayan Shivprasad Bajaj, Joint Secretary to the Government, confirms that the Government of Maharashtra has appointed these six officers to exercise the powers conferred under the Maharashtra Stamp Act, 1958.</p>

<p>Transport Minister Pratap Sarnaik announced that the Maharashtra Government will soon open tenders to develop bus depots across the state on a long-term lease of 98 years. The lease will be structured as 49 years, extendable by another 49 years. He made the announcement while inaugurating the fourth edition of <em>HOMETHON 2025</em>, a three-day mega property exhibition organised by NAREDCO Maharashtra at the Jio World Convention Centre in Mumbai.</p>



<p>Speaking at the <em>Real Estate Forum 2025</em>, held on the sidelines of the property expo, Sarnaik said that the Maharashtra State Road Development Corporation (MSRDC) holds more than 13,000 acres of land at key locations including Kurla, Borivali, and other towns across the state. “To utilise these lands and redevelop the existing bus depots, the government has decided to extend the lease period from the earlier 30 years to 98 years. These ST bus depots will be developed as modern bus ports, similar to the model adopted in Gujarat,” he said.</p>



<p>Sarnaik urged the state’s real estate developers to actively participate in the upcoming tenders for the development of these depots.</p>



<p>He further revealed that the much-awaited pod taxi service will soon commence operations in Bandra-Kurla Complex (BKC) and later expand to other parts of the Mumbai Metropolitan Region, including Mira-Bhayandar and Thane.</p>



<p>Highlighting the government’s commitment to holistic development across sectors, Sarnaik stressed that real estate growth in semi-urban and rural regions will play a crucial role in boosting affordable housing.</p>

<p>In a significant move for the Mumbai real estate and entertainment sectors, PVR Inox Ltd has secured a 15-year lease for a massive 43,534 sq ft retail space in Oberoi Realty’s newly opened Sky City Mall in Borivali. The lease agreement, registered on July 9, 2025, requires a monthly rent of ₹91.42 lakh or a 20% revenue share, whichever is higher, along with a security deposit of ₹10.97 crore.</p>



<p>According to property registration documents acessed by SquareFeatIndia, the deal includes a five-year lock-in period and a 15% rent escalation every 36 months. While PVR Inox was granted access for fit-outs in March 2024, the rent officially commenced on July 30, 2025.</p>



<p>The leasing agreement precedes the recent launch of a state-of-the-art 10-screen megaplex by PVR Inox at the mall. Announced on August 22, 2025, the new cinema spans approximately 43,500 sq ft and has a combined seating capacity of 1,372 seats across its uniquely designed auditoriums, foyers, and lounges.</p>



<p><strong>A Similar Deal for Apple</strong></p>



<p>The PVR Inox transaction follows a similar high-profile deal in the same area. In May 2025, Apple India leased a 12,616 sq ft space for its second store in Maharashtra and fourth in the country. This agreement, with landlord Incline Realty Pvt Ltd (a subsidiary of Oberoi Realty), also includes a revenue-sharing clause.</p>



<p>Apple will pay a monthly rent of ₹17.35 lakh and a revenue share of 2% for the first 42 months, which will increase to 2.5% from the 43rd month onward. The lease for the Apple store is for nearly 11 years (130 months), with a security deposit of ₹1.04 crore and a rent escalation of 15% every three years. The lease has a lock-in period of 10 years and 10 months.</p>



<p><strong>About Sky City Mall</strong></p>



<p>Developed by Oberoi Realty, the Sky City Mall officially opened in March 2025. Located in Borivali East, it is the company’s second mall in Mumbai after the Oberoi Mall in Goregaon. The mall, part of a 25-acre mixed-use project, has a gross leasable area of approximately 12.07 lakh sq ft and is set to become a major retail and entertainment hub for the city.</p>

<p>Bollywood superstar Akshay Kumar has sold two residential units in Oberoi Sky City, Borivali, Mumbai, for a total of ₹6.6 crore, as per property registration documents reviewed by Square Yards on the Inspector General of Registration (IGR) Maharashtra website. Both transactions were officially registered in March 2025.</p>



<h2 class="wp-block-heading"><strong>Prime Location: Borivali’s Rising Real Estate Appeal</strong></h2>



<p>Borivali, located in northwestern Mumbai, is known for its proximity to Sanjay Gandhi National Park, Kanheri Caves, and popular amusement parks like Water Kingdom and Essel World. Borivali East, in particular, is sought after for its greenery and connectivity to key areas like Kandivali East, Dahisar East, and Borivali West.</p>



<p>Oberoi Sky City, developed by Oberoi Realty, is a premium residential project spanning 25 acres, offering 3BHK, 3BHK+Studio, and Duplex apartments. The project has seen strong demand in the real estate market, evident from the significant appreciation in property prices over the years.</p>

The apartment has a carpet area of 100.34 sq. m (1,080 sq. ft). The transaction incurred a stamp duty of ₹32.1 lakh and a registration fee of ₹30,000.</li>



<li><strong>Second Apartment:</strong> Sold for ₹1.25 crore, initially bought in 2017 for ₹67.19 lakh, reflecting an <strong>86% appreciation</strong>. The unit, with a carpet area of 23.45 sq. m (252 sq. ft), incurred a stamp duty of ₹7.5 lakh and a registration fee of ₹30,000.</li>

<p>Akshay Kumar is not the only Bollywood celebrity making real estate moves in Oberoi Sky City. <p>While we have heard about several realty deals in South Mumbai that have crossed ₹100 crore mark, but very rarely that a deal in Mumbai suburbs have been this huge.</p>



<p>Last week a deal took place in Mumbai’s Western suburbs, this deal was worth ₹100 crore.</p>



<p>According to documents accessed by SquareFeatIndia, a unit located on the ground floor of building named Vini Elegance was sold for ₹100 crore.</p>



<p>So who is the buyer of this ₹100 crore property. Documents reveal that the buyer is Titan Company Ltd.</p>



<p>The seller is Nipun Thakkar, and the total area of the shop is 1815.93 Sq Mt.</p>



<p>The deal was signed on May 18, 2023, a stamp duty of ₹6 crore was paid for the registration of the deal. </p>
