<p>Auction for recovery of Rs 36 Lac from Developer in Karjat. The Karjat Tehsildar confiscated the property of the developer and announced the auction on August 22</p>



<p>After Panvel, Pune, for the recovery of the warrants issued by MahaRERA, the auction of developer’s property has also been announced in Karjat area.</p>



<p>In May 2022, MahaRERA had ordered the developer M/S Motang Infrastructure PVt ltd to pay Rs 35.54 lakh to a homebuyer as compensation. This was in connection to Karjat Tehsil office, Kasheli in the area (Pokhrkarkarwadi).</p>



<p>As the concerned developer did not pay the money to the complainant within the time limit, MahaRERA had sent a warrant in this regard to Raigad Collectorate for recovery. The Karjat Tehsildar has taken appropriate action in this regard and an auction has been announced after confiscating the two flats. This auction has been organized in the office of Kasheli Gram Panchayat on August 22 at 11 am subject to certain conditions.</p>



<p>If the developer wants to stop this auction, the compensation amount has to be paid in advance.</p>



<p>Those willing to pariticpate in the auction can visit the site between 11 am to 3 pm till August 15 (excluding government Holidays).</p>



<p>MahaRERA has issued 104 warrants in response to various complaints in 42 projects in Raigad district. The total amount of these warrants is Rs 20.90 crores. Out of these 52 warrants, Rs 6.72 crores have been recovered so far.</p>



<p>Complaints of house buyers regarding non-handover of possession on time by concerned developers (builders), partial abandonment of projects, non-maintenance of prescribed quality etc. come to MahaRERA. The respective developers are ordered to pay interest/damage compensation/refund etc. within the prescribed time frame after hearing these various forms of complaints of the home buyers properly.</p>



<p>Collector’s office plays an important role in recovering the amount if the developer fail to pay the amount within the given period. Therefore such warrants are sent from MahaRERA to the concerned Collectors.</p>

<p><strong>Panvel-Karjat rail corridor to spurt development in the region<em>~ Affordable Housing and Second Homes to get a boost </em></strong></p>

<p>The new suburban railway corridor on Panvel-Karjat is advancing at a gradual pace. The Mumbai Rail Vikas Corporation (MRVC) is scouting for land that runs into acres and is either owned by private, government or its forest land. At present, a single line connects Panvel with Karjat traversing through the talukas of Panvel, Khalapur and Karjat and caters to Goods and long distance passenger trains. The suburban corridor will have five stations of Panvel, Chikale, Mohape, Chowk and Karjat and will pass through 58 bridges.</p>



<p>It has been more than four years since this Rs 2,783 crore new suburban rail line got approved but since then it has been moving at a steady pace. The authorities are currently working on acquiring 32 hectares of land that falls on this 56 kms rail corridor. Of these 9 hectares fall under forest land. As far as private and government land is concerned, the MRVC is trying to work out ways to rehabilitate project affected people with alternate accommodation, land plus compensation. Primary works on this rail line have begun wherever possible. The MRVC authorities will be constructing three tunnels, which incidentally will be the first suburban rail line in Mumbai, that shall have ballast-less tracks.</p>



<p>This is part of Rs 10,947 crore worth Mumbai Urban Transport Project-3 and was supposed to be ready by 2022. However, there has been substantial delay in taking forward this project that was approved in December 2016 and the expected deadline now is 2024.</p>



<p>The Panvel-Karjat corridor  already offers excellent railroad connectivity to the main city—Mumbai and has proven to be the most sought-after region for mixed use townships. Planned development and infrastructure has been a major differentiator for the region compared to the other parts of the city.</p>



<p>Commenting on the development in the region, <strong>Bhasker Jain, Chief Business Officer The Wadhwa Group</strong> said, <em>“The ongoing expansion of the Panvel-Karjat suburban line will add to the existing infrastructural growth and development of the region. Also, the commencement of the work of the Navi Mumbai International Airport and the Mumbai Trans-Harbour Link are the factors that are driving the demand for residential and commercial real estate in this new growth corridor. This has led to a rise in development of Integrated townships, that will lead to a planned growth of populace in the area. Besides high infrastructure growth, the superior air quality and microclimate, dedicated open spaces, abundance of nature and excellent connectivity make the location truly the destination of the future.”</em></p>



<p>As per a study by the Mumbai Railway Vikas Corporation (MRVC), the MMR contributes around 8 per cent of India’s GDP and is home to about 22 million citizens. It anticipates the population in the MMR to grow by around 42 per cent to 28.4 million in 2025 and by 54 per cent to 30.87 million in 2036.</p>



<p>In recent times, the Panvel-Karjat corridor has also emerged as the hub of affordable housing and second homes due to comparatively lower prices, scenic surroundings, good road and railway connectivity and growing infrastructure.</p>



<p>Commenting from the demand perspective,<strong> Dr. Sachin Chopda, Managing Director, Pushpam Group</strong> said, <em>”The extension of the suburban rail corridor on Panvel-Karjat route will offer excellent proximity to the adjoining regions creating a strong demand for property investment. With such fast-paced Infrastructure evolution, exceptional connectivity along with surreal scenic surroundings, most of the homebuyers prefer such locations from their investment perspective to gain regular rentals or consider for the weekend getaways. Owing to certain parameters such as affordability, pleasing weather, blissful activities, open landscape and convenience, the region has witnessed a strong demand for second homes especially for the investor-driven community.”</em></p>

<p>In spite of notices being sent to the builder, and attempts made on Phone to contact this builder, MahaRERA couldn’t. Finally the authority passed an order in favour of homebuyers.</p>

<p>Yes, heard it right, even MahaRERA, couldn’t contact a builder. This after the authority sent the developer notices, and made several attempt to contact the builder over phone. </p>



<h2 class="wp-block-heading">Two homebuyers, Santosh Shukla and Bhushan Trivedi, approached MahaRERA against builder Sheltrex Karjat Pvt Ltd. </h2>



<p>The homebuyers were seeking refund of the amount paid to the builder because of delay in possession.</p>



<p>The builder failed to appear before MahaRERA in spite of notices on September 10 and September 29. </p>



<p>Even after several attempts were made by the authority to contact the builder on phone they couldn’t be reached. </p>



<p>Finally the complainants decided to proceed ex-parte against the builder. </p>



<p>Shukla had paid Rs 7.50 lakh and Trivedi had paid Rs 9.91 lakh to the builder for their homes.</p>



<p>The builder had failed to handover the flats within 36 months from the commencement of construction. </p>



<p>Records show that the builder commenced construction in April 2015, thus possession date was April 2018.</p>



<p>B D Kapadnis, Member II, MahaRERA noted that, section 18 of <a href="https://maharera.mahaonline.gov.in">RERA</a> empowers allottees to withdraw from project, when builder fails to handover possession on agreed dates.</p>



<p>Thus the homebuyers are justified in claiming refund of their amount with interest.</p>



<p>The builder was ordered to refund Rs 7.50 lakh to Shukla with an interest of 9% per annum from date of receipt of the payment till refund.</p>



<p>Similarly the builder was ordered to refund Rs 9.91 lakh with 9% interest per annum to Trivedi.</p>



<p>The builder was also asked by MahaRERA to pay Rs 10,000 to each homebuyer towards cost of their complaints.</p>

<p>The complainants on satisfaction of their claims shall execute the deed of cancellation of their agreements of sale. The builder has been asked to bear the cost. </p>
