<p class="wp-block-paragraph">Real estate giant Macrotech Developers Ltd (commonly known as Lodha) has alleged that House of Abhinandan Lodha (HoABL) committed forgery and fraud to mislead customers and sell plots under the “Lodha” name. The allegations surfaced after Macrotech informed stock exchanges about the purported scam, claiming that HoABL fabricated documents to falsely associate itself with the Lodha brand.</p>



<h3 class="wp-block-heading">Allegations of Forgery and Fraud</h3>



<p class="wp-block-paragraph">According to Macrotech Developers, HoABL orchestrated a scheme to deceive customers by falsely presenting itself as part of the Lodha Group, India’s leading real estate company. The alleged fraud involved forging a board resolution and a PAN card belonging to Ashwani Kumar, an independent director of Macrotech Developers and the former Chairman and Managing Director (CMD) of Dena Bank.</p>



<p class="wp-block-paragraph">The alleged forged resolution, dated July 24, 2022, purportedly allowed the creation of four new companies using the Lodha name:</p>

<li>Lodha Landbuild Infrastructure Pvt Ltd</li>



<li>Lodha Bhoomi Nirman Pvt Ltd</li>



<li>Lodha Land Design Infra Pvt Ltd</li>



<li>Lodha Pictorials Landinfra Pvt Ltd</li>
</ol>



<p class="wp-block-paragraph">Macrotech Developers asserts that no such board meeting took place on the claimed date and that the resolution is entirely fabricated, including the letterhead, company stamp, and the director’s signature. Additionally, the PAN card presented as belonging to Ashwani Kumar allegedly contained a different photograph and signature, raising questions about identity theft and impersonation.</p>



<h3 class="wp-block-heading">The Alleged Scheme</h3>



<p class="wp-block-paragraph">Macrotech claims that the scheme began in 2022 when Varpan Land Developers Pvt Ltd, a lesser-known company under HoABL, allegedly passed a board resolution on July 12, 2022, to change its name to Lodha Landbuild Infrastructure Pvt Ltd or Lodha Bhoomi Nirman Pvt Ltd. Shortly afterward, the alleged forged resolution was used to seek name changes and register new entities under the Lodha brand.</p>



<p class="wp-block-paragraph">Within weeks, on August 4, 2022, the Registrar of Companies (RoC) in Manesar, Haryana, approved the name change request, allowing HoABL to use the Lodha name. Subsequently, HoABL began marketing one of its projects in Goa under the Lodha Landbuild Infrastructure name. According to Macrotech, the project was sold under the Lodha name between September 2022 and April 2023.</p>



<p class="wp-block-paragraph">Once the project sales progressed, HoABL allegedly changed the name of the company to “HOABL Landbuild Infrastructure Pvt Ltd” in April 2023, in an attempt to cover its tracks and distance itself from the Lodha brand.</p>



<h3 class="wp-block-heading">Macrotech Developers’ Response</h3>



<p class="wp-block-paragraph">In its statement, Macrotech Developers expressed shock at the scale of the alleged conspiracy and the misuse of government systems. The company stated:</p>

<p class="wp-block-paragraph">“It is a clear-cut case of forgery, fraud, and impersonation with intent to cheat and deceive. The concerned entities and individuals have created a completely fake resolution of Macrotech Developers Ltd (‘Lodha’) including a false letterhead, false company stamp, false board meeting date, and content which we have never approved, with a false sign of our Independent Director which is nowhere close to his actual signature.”</p>
</blockquote>



<p class="wp-block-paragraph">Macrotech has stated that it is exploring legal action against HoABL and has submitted a detailed report to the stock exchanges.</p>



<h3 class="wp-block-heading">Legal Implications and Next Steps</h3>



<p class="wp-block-paragraph">If proven true, these allegations could have significant legal repercussions, including charges of forgery, fraud, impersonation, and criminal conspiracy. The use of forged documents to mislead customers and government authorities could result in serious penalties.</p>



<p class="wp-block-paragraph">As of now, HoABL has not publicly responded to the allegations. Further investigations are likely to follow as Macrotech pursues legal remedies to address the alleged forgery and identity theft.</p>

<p class="wp-block-paragraph">In a significant development, the Maharashtra Real Estate Appellate Tribunal (MREAT) has directed the arrest and imprisonment of Neptune Ventures & Developers Pvt. Ltd.’s for three months in a case filed by Atul Prabhu. This marks the first time developers have been ordered to serve time under RERA provisions.</p>



<p class="wp-block-paragraph">The tribunal, presided over by Shri Shriram R. Jagtap (Judicial) and Shri S.M. Deshpande (Administrative), issued the directive after repeated non-compliance with previous orders to attach movable and immovable properties belonging to the developers. The case was heard via video conferencing on January 2, 2025.</p>



<p class="wp-block-paragraph">Key highlights of the order include:</p>



<ol class="wp-block-list">
<li><strong>Delay in Property Attachment:</strong><br>Despite a fresh attachment warrant issued on September 27, 2024, the Collector of Mumbai Suburban failed to submit a compliance report. The tribunal has now instructed the Registry to issue another attachment warrant and seek an explanation from the Collector.</li>



<li><strong>Failure to Serve Notices:</strong><br>Notices issued under Section 64 of the RERA Act, 2016, have reportedly not been served to the developers, prompting the tribunal to demand updates on their status.</li>



<li><strong>Imprisonment Directive:</strong><br>The tribunal asked the Registry to request the City Civil Court, Mumbai, to execute the arrest and imprison the judgment debtors who in this case are the developers for three months.</li>
</ol>



<p class="wp-block-paragraph">This landmark ruling aims to enforce accountability and ensure justice for homebuyers who have been waiting for resolution. The tribunal has scheduled the next hearing for February 20, 2025.</p>



<p class="wp-block-paragraph">The decision highlights the increasing stringency of RERA enforcement to safeguard homebuyers’ interests and bring erring developers to justice.</p>

<p class="wp-block-paragraph">CIDCO has filed a complaint against the owner and driver of a dumper caught illegally dumping debris on CIDCO land. The incident occurred on September 3, 2024, at the Vashi Toll Naka, where the dumper was intercepted by CIDCO’s vigilance team.</p>



<p class="wp-block-paragraph">Under the leadership of Chief Vigilance Officer Mr. Suresh Mengde, CIDCO has intensified its crackdown on illegal dumping of debris, soil, and waste on vacant plots in Navi Mumbai. The vigilance department, alongside security, engineering, and police units, conducted the operation. Upon interrogation, the dumper driver admitted to transporting debris for illegal dumping. A case has been registered against the dumper owner and driver at the Vashi police station under Indian Penal Code Sections 271, 329(3), 3(5), and 62.</p>

<p class="wp-block-paragraph">Action has been ordered against residents, occupying flats in a building, which hasn’t received an Occupation Certificate. MahaRERA orders Municipal Corporation to initiate action against builder and residents.</p>

<p class="wp-block-paragraph">There are many buildings where homebuyers have been staying, in spite of a no Occupation Certificate (OC). </p>



<p class="wp-block-paragraph">However, this would be one of those rarest time, when an authority has asked for initiating legal action against such residents.</p>



<p class="wp-block-paragraph">MahaRERA recently asked the secretary, to bring to the <a href="https://maharerait.mahaonline.gov.in/SearchList/SearchJudgements">notice</a> of local Municipal Commissioner about residents in a building without an OC.</p>



<p class="wp-block-paragraph">Actually the complaint was filed by the builder against the landowners stating that the latter was causing obstructions in completion of the project. </p>



<p class="wp-block-paragraph">The project in concern is Nivrutti Heights being developed in Pimpri-Chinchwad Municipal Corporation limits.</p>



<p class="wp-block-paragraph">The respondent in the case informed MahaRERA that although all the amenities weren’t provided yet 45 families were residing in the building. </p>



<p class="wp-block-paragraph">MahaRERA member B D Kapadnis who was hearing the matter noticed that, almost 62 flats were constructed in the building, and according to the promoters who were the complainants only 1% work was left to be completed.</p>



<p class="wp-block-paragraph">Kapadnis further noticed in his order that, 45 families were residing in the building, which is yet not completely constructed. And is not safe to live in absence of fire safety system. He further noticed that, these families were residing in the building without it having an OC.</p>



<p class="wp-block-paragraph">Section 3 (2) (i) of MOFA 1963, prohibits a builder from inducting any person without completion certificate in the flats. It also prohibits the home buyer from taking possession of such flat without Occupancy Certificate. </p>



<p class="wp-block-paragraph">Kapadnis mentioned that the promoter and the occupants have to be proceeded against by the Municipal Corporation under the Maharashtra Municipal Corporation Act. </p>



<p class="wp-block-paragraph">Kapadnis said, “In view of this legal position, I find that it is necessary for this Authority to prosecute the complainants, respondents and all those occupants, who have occupied the premises without OC. Therefore, it is necessary to refer the issue to Municipal Commissioner for taking action in accordance with the law.”</p>



<p class="wp-block-paragraph">MahaRERA, asked the secretary to bring to the notice of the Municipal Commissioner of Pimpri Chinchwad to take legal action against the offenders.</p>



<p class="wp-block-paragraph">Also MahaRERA asked the respondents to not obstruct the completion of the project and installing of fire safety system. </p>



<p class="wp-block-paragraph">The complainants were also asked to complete the project as per the sanctioned plan. They were also asked to provide amenities and fix all the defects pointed out by the respondents. </p>
