<p>In 2025, the Maharashtra Real Estate Regulatory Authority (MahaRERA) delivered a series of landmark decisions that significantly strengthened homebuyer protection and enhanced transparency and accountability within the real estate sector. Collectively, these measures have addressed long-standing concerns around delayed justice, project disclosures, regulatory compliance, and enforcement against errant developers.</p>



<p>Among the most notable achievements of the year were the disposal of a record <strong>6,945 complaints</strong>, the scheduling or hearing of <strong>all complaints registered up to November 2025</strong>, issuance of <strong>4,282 project registration numbers</strong>, integration of <strong>all 481 planning authorities</strong> with MahaRERA’s verification system, and a dramatic improvement in compliance related to quarterly and annual project updates.</p>



<h3 class="wp-block-heading"><strong>All Complaints Registered up to November 2025 Taken Up for Hearing</strong></h3>



<p>There has long been a perception among homebuyers that complaints filed with MahaRERA remained pending for extended periods, sometimes running into years. Recognising that timely redressal is central to protecting the legitimate interests of homebuyers, MahaRERA undertook a comprehensive overhaul of its complaint-handling mechanism.</p>



<p>Under the leadership of <strong>Mr. Manoj Saunik, Chairman, MahaRERA</strong>, along with <strong>Mr. Mahesh Pathak, Member-1</strong>, and <strong>Mr. Ravindra Deshpande, Member-2</strong>, a structured process was implemented to significantly accelerate hearings. As a result, cases that had remained unresolved for several years were successfully taken up and disposed of.</p>



<p>During the calendar year <strong>2025</strong>, a total of <strong>5,039 new complaints</strong> were filed, while <strong>orders were passed in 6,945 complaints</strong>, exceeding the number of fresh filings and providing substantial relief to aggrieved homebuyers. In comparison, <strong>3,824 cases were resolved in 2024</strong> and <strong>2,784 cases in 2023</strong>. The number of complaints filed stood at <strong>3,880 in 2024</strong> and <strong>4,000 in 2023</strong>.</p>



<p>Although <strong>6,916 complaints remain pending</strong>, MahaRERA confirmed that <strong>all complaints registered up to November 2025 have either been heard or have had their hearing dates scheduled</strong>. For the first time since its inception, MahaRERA has achieved a system wherein complaints are acknowledged and scheduled for hearing within <strong>one to two months</strong> of filing.</p>



<h3 class="wp-block-heading"><strong>Clear Criteria Introduced for Out-of-Seniority Hearings</strong></h3>



<p>From 2025 onwards, MahaRERA has mandated that complaints be heard strictly in the order of seniority. However, in compliance with directions from the <strong>Honourable Bombay High Court</strong>, the authority has also laid down specific criteria under which hearings may be conducted out of turn.</p>



<p>Such exceptions apply in cases where the complainant is suffering from a <strong>life-threatening illness</strong>, where a <strong>review or rectification application</strong> has been filed against a MahaRERA order, where <strong>specific directions have been issued by a higher judicial authority</strong>, or where <strong>both parties have reached a mutual settlement</strong>. In cases citing medical grounds, submission of valid medical certificates has been made mandatory.</p>



<h3 class="wp-block-heading"><strong>4,282 Housing Projects Granted MahaRERA Registration in 2025</strong></h3>



<p>Maharashtra continues to lead the country in the number of registered housing projects, and MahaRERA has maintained strict scrutiny while granting registrations, extensions, and amendments. Every project proposal undergoes detailed <strong>technical, financial, and legal evaluation</strong>, with multiple departments working to ensure timely approvals for compliant projects.</p>



<p>As a result of these efforts, <strong>4,282 housing projects</strong> were granted MahaRERA registration numbers in 2025.</p>



<p>City-wise data shows <strong>Pune</strong> leading with <strong>1,144 projects</strong>, followed by <strong>Mumbai City (103)</strong> and <strong>Mumbai Suburban (587)</strong>, which together account for <strong>690 projects</strong>. <strong>Thane</strong> stood third with <strong>675 projects</strong>, followed by <strong>Raigad (384)</strong>, <strong>Nashik (283)</strong>, <strong>Nagpur (281)</strong>, and <strong>Palghar (258)</strong>.</p>



<p>Region-wise, the <strong>Mumbai Metropolitan Region (MMR)</strong> topped the list with <strong>2,119 projects</strong>, followed by the <strong>Pune Region (1,361)</strong>, <strong>Vidarbha (346)</strong>, <strong>Khandesh (319)</strong>, and <strong>Marathwada (137 projects)</strong>, including <strong>91 projects from Sambhaji Nagar</strong>.</p>



<h3 class="wp-block-heading"><strong>All 481 Planning Authorities Integrated for CC Verification</strong></h3>



<p>The state has <strong>481 planning authorities</strong> responsible for issuing construction permissions. Until recently, verification of Commencement Certificates (CCs) was possible online only for projects falling under the Municipal Corporation of Greater Mumbai, while CCs from other authorities had to be emailed manually, leading to delays in project registrations.</p>



<p>In 2025, MahaRERA successfully integrated <strong>all 481 planning authorities</strong> with its system. Approved plans and CCs are now available online, enabling seamless verification, faster processing of registrations, and reduction in potential irregularities.</p>



<h3 class="wp-block-heading"><strong>SOP Introduced for Recovery of Compensation Awarded to Homebuyers</strong></h3>



<p>To ensure effective enforcement of its compensation orders, MahaRERA introduced a <strong>Standard Operating Procedure (SOP)</strong> for recovery. If developers fail to comply with compensation orders, a hearing is conducted within <strong>four weeks</strong>.</p>



<p>Non-compliant developers are required to submit an affidavit disclosing all <strong>movable and immovable assets</strong> as well as <strong>bank account details</strong>. Based on this information, the respective <strong>District Collector’s office</strong> initiates recovery proceedings, including attachment and auction of assets or recovery from bank accounts. Developers who fail to submit the affidavit may be referred to the <strong>Principal Magistrate</strong> and face <strong>imprisonment of up to three months</strong>.</p>



<h3 class="wp-block-heading"><strong>Registration Certificates Now Carry Comprehensive Project Information</strong></h3>



<p>Earlier, MahaRERA registration certificates contained limited details, such as the name and address of the project and promoter. In 2025, the scope of information was significantly expanded.</p>



<p>The certificate now includes the <strong>total project area</strong>, details of <strong>buildings and wings</strong>, number of <strong>floors</strong>, count of <strong>residential and non-residential units</strong>, <strong>Commencement Certificate particulars</strong>, permitted floors, and details of <strong>two-wheeler, four-wheeler, and visitor parking</strong>. Information on <strong>extensions and amendments</strong> is also provided, enabling homebuyers to access all essential project data directly from the certificate.</p>



<h3 class="wp-block-heading"><strong>Mandatory Prominent Display of MahaRERA Details in Advertisements</strong></h3>



<p>MahaRERA has made it mandatory for all housing project advertisements to prominently display the <strong>MahaRERA registration number</strong>, <strong>official website address</strong>, and <strong>QR code</strong>. The font size for these disclosures must be the same as that used for the project’s contact number and address. Any violation attracts penal action against the developer.</p>



<h3 class="wp-block-heading"><strong>Quarterly and Annual Project Update Compliance Rises to 80%</strong></h3>



<p>To empower homebuyers with real-time project information, MahaRERA has strictly enforced the submission of <strong>Quarterly Progress Reports (QPRs)</strong>—including Forms 1, 2, and 3—and <strong>Annual Progress Reports (Form 5)</strong>.</p>



<p>As a result of sustained monitoring and enforcement, the compliance rate has surged to <strong>80% in 2025</strong>, compared to a mere <strong>0.02%</strong> when monitoring first began. These disclosures allow homebuyers to assess a project’s progress and financial status without physically visiting the site.</p>

<p>MahaRERA has sent show cause notices to 45 developers, notices are also being sent to others. Preventive measures taken by MahaRERA and prior permission for the account are also essential to prevent this from happening in the future.</p>



<p>Under Section 4(2)(I)(d) of the Real Estate Act 2016, it is mandatory to have a single bank account for the project of one registration number for the proper completion of the housing projects registered. Meanwhile, the irregularity of 1781 projects linking their bank accounts to more than one project has come to light in the MahaRERA probe.</p>



<p>MahaRERA has taken cognizance of these irregularities and has so far issued show cause notices to 45 such projects. Show cause notices are also being sent to remaining projects.</p>



<p>In order to prevent this from happening in the future, changes have been made in the computer system so that if an attempt is made to link the designated account of one project with the bank account of another project, it will be blocked and cannot be done. Apart from this, now if the developer tries to change the mutual account, that will not happen. Now the MahaRERA issued a new order making the prior approval of the MahaRERA essential for this change.</p>



<p>A built-in discipline should be created in the real estate sector. MahaRERA is meant to bring financial discipline and transparency in the real estate sector so that the investment of every home buyer and similar investors in the sector is safe, the credibility of the real estate sector increases. That is why Maharera has started this micro-control claims the authority.</p>



<p>As per the Real Estate Act, the developer is required to maintain only one bank account with one RERA registration number.<br>The money received from registration in the respective project should be kept in this account only and used for the work of that project only. Elsewhere it should not be diverted. Because if this happens it can have an adverse effect on the project.</p>



<p>Not only this, the developer is also required to keep 70 percent of the money received from the registration of that project in this account. While working on this project, for withdrawing money from this account at each stage, unless the Project Engineer, Project Architect and Project Auditor have a certificate about how much the project has been completed, how much is left, how much money is needed. No withdrawals can be made from this account unless so certified.</p>



<p>Small and large housing projects are going on in the state. MahaRERA has taken steps for micro control of these projects. Financial transactions related to the projects are closely controlled by MahaRERA. MahaRERA has highlighted this irregularity by studying the information submitted by the developers themselves to MahaRERA.</p>



<p>Maharera has taken cognizance of this irregularity and by issuing show cause notices to all, they have been directed to submit all the details of the total number of flats in each project, the number of flats sold, the money received, the money withdrawn from the bank along with the evidence. Against this backdrop, after understanding the statement, further appropriate action will be taken.</p>



<p>Last week, MahaRERA red-flagged 313 projects and began a more thorough inspection of them. Show cause notices have already been issued to all these 313 projects. They are under scrutiny.</p>

<p>These 8 projects have had their registration revoked by MahaRERA, if these 4 lost their registration in September. Hope you haven’t invested or bought a flat in these 8 projects.</p>

<p>Maharashtra Real Estate Regulatory Authority (MahaRERA) has revoked the registration of total 8 projects.</p>



<p>Of these 8 projects MahaRERA revoked the registration of 4 projects in the month of September.</p>



<p>Of these 4 projects, one project lost its registration of September 14, the other one’s registration was revoked by MahaRERA on September 24, whereas the remaining two were declared Ab Initio Void on September 28.</p>



<p>While we give your details of the 8 projects, one should know why registration is important.</p>



<p>According to RERA a developer before selling any flat within Maharashtra has to register their project with <a href="https://maharera.mahaonline.gov.in/Site/1120/Projects---Registration-Revoked-or-Ab-initio-void" target="_blank" rel="noreferrer noopener">MahaRERA</a>.</p>



<p>This is to bring transparency, and accountability on the part of the developer.</p>



<p>The developer during registration has to mention all details fo the projects he’s carrying out. This even included completion date.</p>



<p>If the developer fails to delivery the apartment on or before the date of completion MahaRERA has the powers to levy a fine along with interest.</p>



<p>The 8 projects are</p>

<p>These are the 8 projects which lost their registration. The last 4 that is from 5-8 lost their registration in the month of September 2021.</p>

<p>MahaRERA received a total of 15,239 complaints against registered and unregistered real estate projects. Of this till date it has resolved only these many complaints.</p>

<p>Maharashtra Real Estate Regulatory Authority (<a href="https://maharerait.mahaonline.gov.in/searchlist/PublicViewDashboard" target="_blank" rel="noreferrer noopener">MahaRERA</a>) till date has received a total of 15,239 complaints.</p>



<p>These complaints are against both registered and unregistered real estate projects.</p>



<p>MahaRERA was formed to bring in transparency in the real estate sector.</p>



<p>It started taking complaints of homebuyers against builders who defaulted on possession, or didn’t fulfill the promises made to homebuyers.</p>



<p>The remedy to these solutions were offered by asking the developer to pay interest to the homebuyer or by imposing other penalties.</p>



<p>However, of all the 15,239 complaints received by the authority only 9,841 has been resolved.</p>



<p>MahaRERA, even started taking complaints against the unregistered projects. Unregistered projects are those where developers who were meant to register their projects with the authority but failed to do so.</p>



<p>The authority received a total of 14,437 complaints against registered projects. Of this orders were passed in 9,067 cases.</p>



<p>MahaRERA received a total of 802 complaints against unregistered real estate projects and orders were passed in 774 complaints.</p>



<p>The authority also started a conciliation forum. Under this 755 Conciliationrequests were received with consent from both parties.</p>



<p>In 676 cases the conciliation was completed while the rest are pending.</p>

<p>Many homebuyers who knock the doors of MahaRERA, they mostly wonder on what basis does the authority decides the seniority of their complaint. This article will answer all your doubts.</p>

<p>One of the functions of the MahaRERA is to establish the adjudicating mechanism for speedy redressal of disputes.</p>



<p>Accordingly, as per the provisions of Section 31 of Real Estate (Regulation and Development) Act, 2016 any aggrieved person may file complaint with the MahaRERA for any violation or contravention of the provisions of RERA.</p>



<p>Till date iarge numbers of online complaints have been fiied before the MahaRERA, out of which majority of the complaints have already been decided.</p>



<p>Due to the persistent pandemic situation prevailing since March, 2O2O, MahaRERA adopted system of virtual hearings through Video Conferencing. The process of virtual hearing may continue for further time considering the present pandemic situation.</p>



<p>It has been observed that the number of complaints has been increasing day by day.</p>



<p>When a complaint is registered before the MahaRERA, it is scheduled for hearing before the concerned Bench as per its seniority, which is decided as per the date of registration/filing of the online complaint before the authority.</p>



<p>The authority has also established a conciliation forum for amicable solutions. The forum is functioning as on date, to ensure the speedy disposal of the complaints and also to promote the amicable and effective settlement of disputes arising between the allottees/promoter/ real estate agents as a part of which number of complaints have been referred to the MahaRERA Conciliation Forum. Complaints are referred only after seeking consent of the parties in a hearing before the authority.</p>



<p>if a complaint is referred to the MahaRERA Conciliation Forum for availing the possibility of amicable settlement and if the conciliation between the parties fails, in that event, the complaint will then referred back to the MahaRERA for hearing the same on merits and on receipt thereof, such complaints would be scheduled for hearing as per the original seniority of the said complaint and the seniority of the complaint would be decided as per the date of registration/frling of the complaint.</p>



<p>Hence, even if a complaint is referred to the conciliation forum, the seniority of the complaint will remain intact. The hearing/ decision of such complaints shall be taken up strictly as per their seniority.</p>



<p>However, due to any unavoidable circumstances, if the seniority of any complaint has to be changed, in that event a proper/ reasoned justification should be submitted before the Chairperson, and only on the approval, the seniority of such complaints could be changed.</p>



<p>A <a href="https://maharera.mahaonline.gov.in/Upload/PDF/Circular%20No%2030.pdf" target="_blank" rel="noreferrer noopener">circular</a> in this regards was issued by the secretary of the authority last week.</p>
