MahaRERA Appellate Tribunal Rejects Developer’s Appeal Over Delay in Filing

The Maharashtra Real Estate Appellate Tribunal has dismissed an appeal by developer Nitin Navgire, citing an unjustified 23-month delay and failure to comply with RERA’s legal requirements.

MahaRERA Directs Developer to Allocate Car Parking to Homebuyers, Warns of Penalty for Non-Compliance

The Maharashtra Real Estate Regulatory Authority (MahaRERA) has ordered the developer of Suyog Nisarg Phase III to allocate promised car parking spaces to three homebuyers within 30 days. The ruling, delivered after the developer’s absence from the hearing, warns of penalties for non-compliance and highlights ongoing registration and compliance issues with the project.
In a key ruling, MahaRERA held that even when an Agreement for Sale is silent on the possession date, the builder must hand over the flat within a reasonable period of three years from the agreement date — failing which, interest is payable for the delay period. The order in the Mauli Omkar project case awarded interest from March 2019 to April 2023 to complainant Sabirali Tufhel Shaikh.

HDIL Insolvency Proceedings Stall MahaRERA Complaint – Homebuyers Left in Limbo
