<p>In a major policy intervention aimed at reviving Mumbai’s ageing public housing stock, the Maharashtra government has approved a <strong>special cluster redevelopment policy for MHADA colonies spread over 20 acres or more</strong> in Mumbai and its suburban areas. The policy, notified through a Government Resolution (GR) issued by the Housing Department on December 15, 2025, is expected to unlock redevelopment of large MHADA layouts that have remained stalled for decades.</p>



<p>The decision directly benefits <strong>existing residents living in old MHADA colonies</strong>, many of which were constructed between <strong>1950 and 1960</strong> for low- and middle-income households and are now structurally weak. At the same time, the policy is expected to <strong>indirectly benefit future homebuyers</strong> by unlocking new, regulated housing supply in land-starved Mumbai.</p>

<h2 class="wp-block-heading">Why the Policy Was Needed</h2>



<p>MHADA developed <strong>56 large housing colonies</strong> across Mumbai and the suburbs in the post-Independence period, housing nearly <strong>5,000 cooperative housing societies</strong>. Most of these buildings are now <strong>50–60 years old</strong>, with several declared dilapidated or unsafe.</p>



<p>While redevelopment has been attempted over the years, progress remained slow due to:</p>

<h2 class="wp-block-heading">What the New Cluster Redevelopment Policy Allows</h2>



<p>Under the new policy, <strong>MHADA colonies measuring 20 acres or more</strong> can be redeveloped as a <strong>single, integrated project</strong> under <strong>Development Control and Promotion Regulations (DCPR) 2034</strong>, primarily using <strong>Regulation 33(5)</strong> and, where necessary, <strong>Regulation 33(9)</strong>.</p>



<p>The objective is to ensure:</p>

<li>Modern infrastructure and civic amenities</li>



<li>Safer buildings and improved living standards</li>

<h2 class="wp-block-heading">MHADA to Lead, Developers to Be Appointed by Tender</h2>



<p>Unlike conventional private redevelopment, these projects will be:</p>

<li>Executed through a <strong>Construction &amp; Development Agency (C&amp;DA)</strong></li>



<li>Selected via <strong>transparent competitive bidding</strong></li>

<li>Cooperative housing societies must submit <strong>legally valid resolutions</strong></li>



<li>MHADA retains oversight of rehabilitation entitlements</li>



<li>Existing residents will be rehoused strictly as per DCPR norms</li>

<p>This provision aims to prevent redevelopment from being blocked by a small minority.</p>

<p>The responsibility for rehabilitation, transit rent, and amenities will rest entirely with the appointed C&amp;DA.</p>

<p>In a significant relaxation, buildings that:</p>

<li>Will complete 30 years during the project lifecycle</li>
</ul>



<p>may also be included in the cluster redevelopment with MHADA’s approval. This ensures uniform redevelopment of entire colonies without leaving behind isolated buildings.</p>

<h2 class="wp-block-heading">Mixed MHADA and Private Land: Clear Rules</h2>



<p>For redevelopment layouts involving both MHADA and private land:</p>



<ul class="wp-block-list">
<li>If <strong>MHADA land exceeds 50%</strong>, MHADA will act as the <strong>planning authority</strong></li>



<li>If <strong>MHADA land is less than 50%</strong>, redevelopment will follow standard DCPR 2034 norms, with MHADA acting as the <strong>implementing agency</strong></li>
</ul>



<p>This clarity resolves long-standing jurisdictional confusion.</p>

<p>To curb prolonged delays:</p>

<li>Members obstructing approved redevelopment may face removal</li>
</ul>

<p>The GR reiterates that:</p>

<li>Regulation <strong>33(9)</strong> may be used only if 33(5) projects are financially unviable</li>

<p>Even in such cases, MHADA’s entitlement under 33(5) will be protected.</p>
