<p>The Bombay High Court has directed the Maharashtra Housing and Area Development Authority (MHADA) to cease transit rent payments to tenants of the long-stalled Patra Chawl (Siddharth Nagar) redevelopment project in Goregaon East starting from April 2026. A division bench comprising Justices G. S. Kulkarni and Aarti Sathe issued the order on March 11, 2026, in Writ Petition No. 651 of 2025, highlighting the substantial financial strain on the public exchequer due to prolonged delays in handing over completed rehabilitation flats.</p>



<p>The Patra Chawl project, plagued by controversies since its inception around 2008, involved rehabilitating over 670 tenant families from dilapidated structures. Initial developer involvement led to allegations of fraud and a massive ₹1,039-crore scam, prompting MHADA to take direct control. Construction of the rehabilitation buildings (Nos. 1–8, totaling 16 wings) has since been completed, and an interim structural audit by Veermata Jijabai Technological Institute (VJTI), led by Professor Dr. Abhay Bambhole, confirmed the structures are “structurally sound, stable, and fit for habitation.”</p>



<p>In its February 23, 2026, order, the court had already permitted MHADA to execute Permanent Alternate Accommodation Agreements (PAA Agreements) and hand over possession to willing occupants, based on the VJTI report.</p>



<p>The March 11 hearing was urgently moved by MHADA, which alleged obstruction by the petitioner society—Goregaon Siddharth Nagar Sahakari Griha Nirman Sanstha Limited—and its Managing Committee. Officials and the contractor (Relcon Infraproject) reportedly faced resistance in entering the site, completing formalities, or delivering flats, leading to a non-cognizable (NC) complaint at the local police station. MHADA claimed some members were being prevented from taking possession despite willingness, and delays persisted in signing standard PAA Agreements through unwarranted objections.</p>



<p>The court expressed strong disapproval, stating such actions disregarded its prior directions and could constitute obstruction of public servants’ duties, potentially inviting criminal prosecution or contempt proceedings. It emphasized the need for “absolute co-operation” from the society and members, noting the premises have been ready for occupation for an extended period.</p>



<p>MHADA’s counsel highlighted the financial toll: transit rent (temporary accommodation compensation) had already cost the state exchequer approximately <strong>₹18 crores</strong> over more than a year post-completion. The authority argued tenants could not indefinitely delay possession while receiving rent, causing avoidable public loss.</p>



<p>The bench concurred, ruling that MHADA may stop transit rent payments from <strong>April 2026</strong> onward. It directed MHADA to proceed with handing over possession to willing members, who can register requests via an email ID provided by MHADA (to be shared with the society’s Chairman-Secretary, Managing Committee, and advocate).</p>



<p>To ensure smooth progress, the court ordered a meeting on <strong>March 12, 2026, at 3:00 p.m.</strong> in MHADA’s office to discuss and finalize PAA Agreements. It appointed a Court Observer (a senior officer from the Registrar, Original Side) to monitor meetings and site visits, with authority to requisition police assistance if obstructions arise. MHADA or the contractor must deposit <strong>₹50,000</strong> initially toward the observer’s charges.</p>



<p>Members with grievances were advised to submit representations to MHADA for lawful consideration, but the court warned against unwarranted delays or objections. The matter stands adjourned to <strong>March 25, 2026</strong>, with permission for additional affidavits.</p>



<p>This ruling accelerates resolution in one of Mumbai’s most infamous delayed redevelopment cases, prioritizing willing tenants’ access to completed homes while addressing public expenditure concerns amid ongoing allegations of obstruction.</p>

<p>As a journalist who has covered Mumbai and it’s real estate sector for close to two decades, whenever I hear Patra Chawl, otherwise known as Siddharth Nagar, the faces of hundreds of residents flash in front of me. Today I write again as Patra Chawl has become the major reason for ED knocking the doors of Sanjay Raut.</p>



<p>In the last one decade or more, many residents of Patra Chawl located in Mumbai’s Goregaon area have contacted me, to write their ordeal and I did too. Let’s go back in history, almost 15 years ago, in 2008 MHADA got into a tri-partie agreement with a private developer named Guru Ashish Constructions and the tenants society comprising of 672 tenants of the Chawl.</p>



<p>Spread over 47 acre of land, the builder who turned greedy, instead of rehabilitating the tenants started looking for his personal profits, he started selling the saleable portions first, including selling FSI belonging to the land was sold to 9 different developers.</p>



<p>Meanwhile, severs tenants started approaching MHADA as by 2014 as rents to many of them had stopped. For those out of Mumbai, and reading this when a developer takes over a redevelopment project he pays rent to the society members till he has constructed and hands over them the possession of their house.</p>



<p>Reports suggest that since ED started it’s investigation it found that Pravin Raut, an alleged close associate of Sanjay Raut, and also of some directors of Guru Ashish Constructions had started misleading MHADA within a few years of the agreement. It is pegged that Pravin Raut allegedly sold the floor space index (FSI) to nine private developers, collecting Rs 901.79 crore. The developer is allowed to sell the FSI no doubt but only after he has constructed and rehabilitated the tenants and in this case since 2008 till date the tenants are awaiting their homes.</p>



<p>Most tenants hail from middle class community and have been actually suffering because they lost their home to a developer who had promised them rent and a home back. However, they received none. I wouldn’t be wrong to say that most of these tenants hail from the Maharashtrian community, of which Sanjay Raut claims to be the biggest leader of.</p>



<p>Coming back to Sanjay Raut reports further claim that ED has stated that Pravin Raut an alleged close aide of Sanjay Raut received Rs 100 crore from real estate company and then it was allegedly diverted to various accounts of his alleged close associates, and even family members. Sanjay Raut’s name has already featured as his alleged close aide several times now.</p>



<p>Another report suggests that ED has alleged that as early as 2010 just two years of the agreement, Rs 83 lakh, was allegedly transferred to Sanjay Raut’s wife Varsha Raut, who apparently used the money to buy a flat in Dadar.</p>



<p>The other allegation is that around eight plots of land were purchased at Alibaug in the name of Varsha Raut and another woman Swapna Patkar. The last name may ring a bell, for that go to twitter and look for it.</p>



<p>The builder who was only interested in profit had even allegedly duped several home buyers, by selling them homes in the building.</p>



<p>It is believed that the Patra Chawl scam is of no less than Rs 1000 crore and is a classic example of making the poor common citizens suffer and the nexus of Politicians-Builder-Babu who made hoards of money.</p>



<p>The investigation should also move in the offices of MHADA and those officials who were suppose to be accountable to get these tenants a home but failed.</p>



<p>Earlier this year, MHADA, the state’s housing body had announced that it will be constructing homes for the 672 tenants of Siddharth Nagar or Patra Chawl and give them homes measuring 650 square feet. The inauguration programme for the same was attended by then Chief Minister Uddhav Thackeray and NCP chief Sharad Pawar. Sanjay Raut is undoubtedly close to both of them.</p>

<p>Patra Chawl tenants who have been awaiting for a home since a long time, may have their own home. On Tuesday chief minister will be inaugurating the construction work.</p>

<p>Patra Chawl residents can celebrate at least for now as their is some good news for them.</p>



<p>On Tuesday, Maharashtra Housing and Regional Development Authority (MHADA) Siddharth Nagar (Patra chawl) Goregaon Redevelopment Project Construction of Pending Flats will be inaugurated by Maharashtra Chief Minister Uddhav Thackeray at 5 pm at Prabodhan Kridabhavan, Goregaon West.</p>



<p>The issue of construction of pending flats of 672 original tenants of Siddharth Nagar Co-operative Housing Society (Patra chawl) redevelopment project on MHADA land at Goregaon West, Mumbai will be solved through this. 672 tenants will get 650 sq. ft. Carpet area flats through redevelopment project.</p>



<p><a href="http://mhada.gov.in" target="_blank" rel="noreferrer noopener">MHADA </a>itself is working on this entire project as a developer for the redevelopment of Patra Chawl which is spread on 47 acres of land.</p>



<p>Earlier a tripartite agreement was signed between Guruashish Construction Pvt. Ltd. and MHADA. However, the developer delayed the redevelopment project for many years and due to non-payment of rent by the developer to the residents, MHADA issued a termination notice to the concerned developer and organization on 12.01.2018.</p>



<p>The developer sold the sale share of this project to 9 developers without the permission of MHADA, so these 9 developers filed suit in the Hon’ble High Court. Due to various such incidents, the redevelopment project has been stalled for the last several years.</p>

<p>A one member committee comprising of Retired Chief Secretary of the State of Maharashtra, Johnny Joseph was formed to look into the matter. The committee has submitted its detailed report to the government in two parts. Following the recommendations of Johnny Joseph’s report, through the Vice President and Chief Executive Officer a feedback was submitted to the government of Maharashtra in March 2021.</p>



<p>Following the recommendation of the committee and the feedback received from MHADA. Following the decision taken by the Cabinet in the Cabinet meeting held on 23rd June, 2021, the Housing Department of the State of Maharashtra Government Resolution issued on July 09, 2021. Accordingly, construction of pending flats on R-9 plot for rehabilitation of original 672 members of Patra chawl Housing Society is starting today (Tuesday).</p>



<p>The construction of the rehabilitation building on R-9 plot is largely incomplete. As the structural construction of the buildings on this plot has been in an incomplete condition for the last 4 years, a structural inspection was carried out by VJTI. After conducting a structural inspection and incorporating their recommendations a tender was floated/</p>



<p>Tender was opened by MHADA for this construction A letter of acceptance has been given to the first lowest bidder, M / s. Railcon Infra Projects Limited with the approval of the tender authority of Maharashtra Housing and Regional Development Authority.</p>

<p>MHADA finally has decided to do something with the long struck redevelopment project in Goregaon. The housing body has floated a tender worth ₹142 crore</p>

<p>MHADA’s Mumbai Board floated a tender last week for carrying out various work at Patra Chawl Redevlopmemt.</p>



<p>The works include, Survey, planning, designing, building construction, structural restoration, obtaining all relevant permissions, amendments and required completion/occupancy certificate from concerned local authority on lumpsum turnkey basis for construction of balance work of rehab portion at sector R-9 of Siddharth Nagar Patra chawl redevelopment project located in Goregaon West Mumbai.</p>

<p>The e-tender dates are from November 2 to December 17 the pre-bid date is November 17 at 11 AM in the office of the chief engineer at MHADA headquarters.</p>



<p>The e-tender will be opened on December 21, 2021.</p>



<p>The tender has been floated by Mumbai Board of MHADA.</p>



<p>The housing minister of state, Jitendra Awhad <a href="https://twitter.com/awhadspeaks/status/1451771833238245378?s=21" target="_blank" rel="noreferrer noopener">tweeted</a>, “The redevelopment project of Patra Chawl at Goregaon, which has been stalled for the last several years, is being launched. The ad has come out. Actual work will begin in the next few days and those displaced in Patra Chawl will get their own homes.”</p>

<p>Patra Chawl for a long time has been stuck for various reasons.</p>



<p>In the year 2007, the project of redevelopment of Patra Chawl was given to a private developer by MHADA.</p>



<p>The area of the project is close to 47 acre comprising of 675 tenants.</p>



<p>Earlier this year, chief minister of the state Uddhav Thackeray asked MHADA to formulate a strategy and work on a plan to redevelop Patra Chawl and rehabilitate the tenants.</p>
