<p class="wp-block-paragraph">In a significant order, the Maharashtra Real Estate Regulatory Authority (MahaRERA) has clarified that deregistration of a real estate project does <strong>not</strong> allow promoters to escape their earlier liabilities and obligations.</p>



<p class="wp-block-paragraph">In Regulatory Case No. 447 of 2025, MahaRERA allowed the deregistration of the project <strong>“Prithvi Sneh”</strong> (MahaRERA Reg. No. P51700006513) located at Ghodbunder, Mira Bhayandar, Thane. The promoter, Prithvi Buildworth Construction, had sought deregistration after the Development Agreement with the landowner (M/s. Jai Laxmi Constructions) was mutually cancelled in August 2024.</p>



<p class="wp-block-paragraph">The promoter argued that it no longer held development rights over the land and that there were no allottees in the “Prithvi Sneh” building. It also claimed that the complaints filed in the project actually pertained to another building “Sneh Crown” being developed by the landowner. After verifying that no objections were received from the public and noting the cancellation of the development agreement, MahaRERA permitted the deregistration.</p>



<p class="wp-block-paragraph"><strong>However, the Authority made it crystal clear that deregistration is not a clean chit.</strong></p>



<p class="wp-block-paragraph">Member Mahesh Pathak categorically stated that the deregistration <strong>shall not absolve</strong> the promoter from complying with the earlier orders passed by MahaRERA, including the final order dated 25th August 2020, interim order dated 11th February 2021, and the non-compliance order dated 6th January 2023. The order explicitly mentions that the validity, enforceability, and execution of these earlier orders will remain unaffected despite the deregistration.</p>



<p class="wp-block-paragraph">This order sends a strong message to promoters that exiting the RERA registration system will not help them evade accountability for past violations. Homebuyers and complainants can still pursue remedies based on previous RERA directions, including recovery of penalties or refunds, if applicable.</p>



<p class="wp-block-paragraph">The case also highlights the complex structure of some projects where multiple parties (promoters and landowners) are involved, often leading to disputes over liabilities. MahaRERA has maintained that while it may allow deregistration in deserving cases where the promoter has genuinely lost development rights, it will not permit such moves to defeat the rights of allottees or nullify its own earlier enforceable orders.</p>



<p class="wp-block-paragraph">This ruling assumes importance for homebuyers stuck in stalled or disputed projects across Maharashtra, reaffirming that RERA’s protective measures continue even after a project’s registration is cancelled.</p>

<p class="wp-block-paragraph">The Maharashtra Real Estate Regulatory Authority (MahaRERA) has officially deregistered the residential project “Marvel Castella A and B Building” following a successful application by the promoters citing financial difficulties and lack of intent to proceed with construction.</p>



<p class="wp-block-paragraph">In an order dated 26th May 2026, Member II Ravindra Deshpande allowed the deregistration of the project bearing RERA Registration No. <strong>P52100002438</strong>, promoted by <strong>Marvel Sigma Homes Private Limited</strong> and land-owning partner <strong>Runal Developers</strong>.</p>



<p class="wp-block-paragraph">According to the order, the project had 22 allottees at the time of registration. The promoters submitted detailed proof that all allottees have been fully refunded and their bookings cancelled. Out of 22 allottees, 17 had executed registered Agreements for Sale, all of which were cancelled through registered cancellation deeds. The remaining 5 allottees, who had signed only booking forms, submitted affidavits confirming receipt of refunds and cancellation of bookings.</p>



<p class="wp-block-paragraph">The Authority noted that six complaints were filed against the project, all of which have been disposed of — either through refunds with interest or withdrawal after settlement. The promoters also produced affidavits and Index-II documents as evidence of full and final settlement with every allottee.</p>



<p class="wp-block-paragraph">MahaRERA had issued notices to all 22 allottees as well as a public notice inviting objections for deregistration. However, no allottee appeared for the hearings nor raised any objection. The public notice also received zero objections.</p>



<p class="wp-block-paragraph">In its detailed reasoning, MahaRERA observed that the primary objective of the Real Estate (Regulation and Development) Act, 2016 is to protect homebuyers and ensure project completion. Since the promoters have no intention to develop the project and all homebuyers’ interests have been fully protected through refunds, continuing the registration served no purpose.</p>



<p class="wp-block-paragraph">The Authority has strictly directed the promoters not to advertise, market, book, sell, or invite any bookings for the Marvel Castella project henceforth.</p>



<p class="wp-block-paragraph">This order highlights MahaRERA’s pragmatic approach in closing non-viable projects where homebuyers have already been compensated, thereby cleaning up its registry of dormant projects.</p>

<p class="wp-block-paragraph">MahaRERA has turned down promoter Anil Tharwani’s request to cancel the registration of Tharwani Ariana Phase IV, citing incomplete disclosures, missing buyer protections, and direct contradictions in the promoter’s own statements. The order, issued by Chairperson Manoj Saunik on 10 March 2026, leaves the original 2017 registration active and imposes a ₹20,000 penalty on the promoter.</p>



<h3 class="wp-block-heading">Chronological Sequence of Events</h3>



<p class="wp-block-paragraph">Here’s exactly how the case unfolded:</p>

<li><strong>August 2017</strong>: Tharwani Ariana Phase IV is registered with MahaRERA (Registration No. P51700007834).</li>



<li><strong>30 November 2020</strong>: The promoter files a declaration stating “no bookings accepted and no construction commenced” and promises to apply for fresh registration only if the project restarts.</li>



<li><strong>9 August 2022</strong>: A second registration (P51700047534) is obtained for the same land parcel — later claimed as an “inadvertent employee error” during the post-COVID transition.</li>



<li><strong>30 September 2024</strong>: The promoter applies to deregister the original 2017 project, saying the duplicate was a mistake.</li>



<li><strong>27 October 2025</strong>: MahaRERA hears the case and directs the promoter to submit full booking details, allottee contacts, payment status, settlement proofs (if any), and proper consents.</li>



<li><strong>10 March 2026</strong>: The application is rejected. Promoter ordered to pay ₹20,000 cost within 30 days; fresh application allowed only after compliance.</li>
</ul>



<h3 class="wp-block-heading">Why MahaRERA Said “No”</h3>



<p class="wp-block-paragraph">The Authority found several serious issues:</p>



<ul class="wp-block-list">
<li>Only 47 out of 60 allottees gave consent — and even those consent letters did not mention that the purpose was deregistration.</li>



<li>The 60 bookings directly contradict the promoter’s 2020 “no bookings” declaration.</li>



<li>Two different commencement certificates were filed for the same project, with no explanation.</li>



<li>Quarterly Progress Reports (QPRs), Form 3 and Form 5 were never updated under the original registration — everything was uploaded only under the new number.</li>



<li>Complete details of money received and current status of each booking were never placed on record.</li>
</ul>



<p class="wp-block-paragraph">Without these basic facts, MahaRERA said it could not confirm that homebuyers’ rights and interests had been protected.</p>
