<p class="wp-block-paragraph">A project report on the table is not a tender. Under the Government Order of 30 September 2026, No. SGRYO-2026/C.R. 108/14-S, the committee cannot shop for a developer on two moving numbers at once. The architect must freeze either the carpet area or the corpus fund, and compete on the rest. Fewer than three bids, and the society must extend the tender before it proceeds. Members get the report before the committee approves it. A builder the committee already prefers does not replace that notice.</p>



<p class="wp-block-paragraph">The order is under Section 79A of the Maharashtra Co-operative Societies Act, 1960. It supersedes the 4 July 2019 resolution. This part is paragraphs 10 and 11: what happens after the report arrives, and how the tenders are opened. The meeting that actually selects the developer is the next part.</p>



<h2 class="wp-block-heading">The report is shown to members before the committee approves it</h2>



<p class="wp-block-paragraph">Once the project report is received, the Secretary must call a managing committee meeting within 30 days. The architect or project management consultant is invited to that meeting.</p>



<p class="wp-block-paragraph">The notice, with the time and venue, goes on the society’s notice board. It must also tell every member that a copy of the report is available for inspection at the society’s office, and that suggestions must be sent 7 days before the committee meeting. The acknowledgement is kept.</p>



<p class="wp-block-paragraph">The Secretary forwards those suggestions to the architect or consultant. At the meeting, the suggestions, the members’ recommendations and the consultant’s views are discussed. The report is then approved by majority, with whatever changes are necessary.</p>



<p class="wp-block-paragraph">A report approved before members have had that inspection window is not the sequence in this clause.</p>



<h2 class="wp-block-heading">One number stays still, so the bids can be compared</h2>



<p class="wp-block-paragraph">At the same committee meeting, a draft tender is prepared. The date, time and venue of the next Special General Meeting, the one that will finalise that draft, are fixed.</p>



<p class="wp-block-paragraph">While the draft is prepared, the architect or consultant must keep one of two things constant and unchanged: either the carpet area, or the corpus fund. The other technical matters are fixed so that reputed and experienced developers can bid against the same base.</p>



<p class="wp-block-paragraph">If both carpet and corpus are left open, the bids are not comparable. That is the point of the clause. The draft is then placed before the members at the Special General Meeting and approved by majority.</p>



<h2 class="wp-block-heading">The notice is public, and members may call builders they know</h2>



<p class="wp-block-paragraph">After that approval, a public notice is published in the Marathi and English newspapers with the largest local circulation, and tenders are invited.</p>



<p class="wp-block-paragraph">Members are also free to tell reputed and experienced developers they know about the tender, and to invite bids from them. The committee is not the only door through which a bid can arrive.</p>



<h2 class="wp-block-heading">The list goes on the board the day the tenders close</h2>



<p class="wp-block-paragraph">On the last day for receipt of tenders, the Secretary prepares a list of the number of tenders received and publishes it on the notice board.</p>



<p class="wp-block-paragraph">The Secretary then convenes a Special General Meeting within 30 days of that last date. Tenderers, or their authorised representatives, cannot be refused entry. The tenders are opened in the presence of everyone at the meeting.</p>



<p class="wp-block-paragraph">The architect or consultant scrutinises the bids, prepares a comparative statement, and examines quality, reputation, experience and the rates. If at least three tenders have come in, those tenders are approved to be placed before the Special General Meeting.</p>



<h2 class="wp-block-heading">Fewer than three bids means time is added, not a private shortlist</h2>



<p class="wp-block-paragraph">At least three tenders are required for the bidding to be competitive. If fewer than three are received, an extension of at least 15 days is given first. If the number is still below three, a second extension of one week is given.</p>



<p class="wp-block-paragraph">Only after that second extension, if fewer than three tenders have still come in, may the society place before the meeting as many tenders as it has received.</p>



<p class="wp-block-paragraph">If the tenderers are to be allowed to submit revised bids, they must be permitted to do so, and the society follows the same opening procedure again.</p>



<p class="wp-block-paragraph">This part ends when the tenders have been opened, compared, and cleared to go before the meeting. The selection of one developer, in the presence of the Registrar’s representative, is the next part.</p>
