<p class="wp-block-paragraph">Sri Lotus Developers & Realty Limited has been appointed, through its subsidiary, as the developer for a large-scale commercial-cum-retail redevelopment project in Juhu, Mumbai, with an estimated Gross Development Value (GDV) of ₹1,600 crore.</p>



<p class="wp-block-paragraph">The project involves the redevelopment of a prominent and established commercial shopping complex in Juhu and is expected to further strengthen Sri Lotus Developers’ presence in Mumbai’s premium commercial and retail real estate market.</p>



<p class="wp-block-paragraph">The proposed development is expected to have an estimated total carpet area of approximately 3.46 lakh sq. ft. and will comprise premium commercial and retail spaces.</p>



<p class="wp-block-paragraph">According to the company, construction is expected to commence in Q3 FY28, with completion targeted within approximately three to four years from the start of the project.</p>



<p class="wp-block-paragraph">The appointment adds another major project to Sri Lotus Developers’ growing redevelopment portfolio. The company has been focusing on redevelopment and joint development opportunities, particularly in Mumbai’s premium and supply-constrained locations.</p>

<p class="wp-block-paragraph">The company said the project is positioned to benefit from the limited availability of fresh commercial supply in Juhu, a prime Mumbai micro-market.</p>

<p class="wp-block-paragraph">According to Pandit, Juhu’s strategic location and limited fresh supply make it well positioned to benefit from this trend.</p>



<p class="wp-block-paragraph">He added that the company expects continued demand from institutional occupiers for professionally executed commercial redevelopment projects and intends to focus on design quality and long-term value creation.</p>

<p class="wp-block-paragraph">In a significant ruling strengthening the financial powers of cooperative housing societies, the <strong>Bombay High Court</strong> has held that <strong>society maintenance and service charge dues can be recovered from occupiers or flat holders, even if they are not formal members and even if no registered sale agreement exists</strong>.</p>



<p class="wp-block-paragraph">The Court categorically ruled that <strong>liability to pay society dues “runs with the flat”</strong> and is enforceable against the person <strong>in possession and enjoyment of the premises</strong>, irrespective of technical deficiencies in documentation.</p>



<p class="wp-block-paragraph">The judgment has far-reaching implications for redevelopment projects, old buildings, SRA schemes, and long-pending ownership disputes across Maharashtra.</p>

<p class="wp-block-paragraph">In a landmark moment for Mumbai’s urban transformation, the long-awaited redevelopment work of <strong>Mata Ramabai Ambedkar Nagar</strong> in Ghatkopar is set to begin today, marking the launch of one of the <strong>largest slum rehabilitation projects in the Mumbai Metropolitan Region (MMR)</strong>.</p>



<p class="wp-block-paragraph">Maharashtra Chief Minister Devendra Fadnavis is scheduled to inaugurate the <strong>foundation stone ceremony at 2 PM</strong>, setting in motion a massive rehabilitation and redevelopment effort that will directly impact nearly <strong>17,000 slum dwellers</strong>.</p>

<p class="wp-block-paragraph">For years, the redevelopment of Mata Ramabai Ambedkar Nagar and Kamaraj Nagar remained stalled due to land ownership issues, eligibility verification, and administrative hurdles.</p>



<p class="wp-block-paragraph">It was only through a <strong>Government Order issued on 21 September 2023</strong> that the Mumbai Metropolitan Region Development Authority (MMRDA) was officially permitted to undertake the Slum Rehabilitation Scheme in <strong>joint venture with the Slum Rehabilitation Authority (SRA)</strong>. This marked the <strong>first time in MMRDA’s 50-year history</strong> that the agency would act as a <strong>developer</strong> on a slum rehabilitation project.</p>

<p class="wp-block-paragraph">Out of the total government land required, <strong>15.63 hectares have already been transferred to MMRDA</strong>, enabling work to begin on-site.</p>

<p class="wp-block-paragraph">Additionally, <strong>₹137.50 crore in advance rent</strong> has been paid to eligible residents to support them during the construction phase.</p>

<p class="wp-block-paragraph">The Government of Maharashtra has announced an <strong>unprecedented housing construction drive</strong> across the <strong>Mumbai Metropolitan Region (MMR)</strong> over the next five years. The plan involves building <strong>35 lakh homes</strong> backed by <strong>₹50 lakh crore of public and private investment</strong>, aiming to reshape the region’s housing landscape through large-scale redevelopment, affordable housing, and infrastructure expansion.</p>



<p class="wp-block-paragraph">The announcement was made by <strong>Deputy Chief Minister and Housing Minister Eknath Shinde</strong> at the <strong>MHADA Konkan Board computerized lottery draw</strong> held in Thane, where 5,354 tenements and 77 plots were allotted through a transparent digital process.</p>

<p class="wp-block-paragraph">The state is also working towards the <strong>PM Awas Yojana (Urban)</strong> target of <strong>two crore homes</strong>, with an emphasis on housing for <strong>working women, senior citizens</strong>, and <strong>rental housing options</strong> to address urban housing demand.</p>



<p class="wp-block-paragraph">Shinde highlighted that the <strong>Central Government’s GST reduction on housing</strong> has further lowered costs, offering <strong>relief to homebuyers</strong> and boosting construction momentum.</p>

<p class="wp-block-paragraph">The massive response to the Konkan Board lottery — <strong>1,58,424 applications for 5,354 homes</strong> — reflects <strong>rising public trust in MHADA’s transparent allotment systems</strong>, Shinde noted. He instructed MHADA to <strong>maintain quality standards</strong> and ensure projects are completed <strong>within stipulated timelines</strong> to meet this ambitious target.</p>

This includes several <strong>long-delayed schemes</strong> that are now being fast-tracked under the revised housing policy.</p>



<p class="wp-block-paragraph">Key redevelopment projects expected to contribute around <strong>two lakh homes</strong> in the next five years include:</p>

<p class="wp-block-paragraph">These projects are expected to <strong>unlock large tracts of underutilized urban land</strong>, paving the way for <strong>affordable and mid-income housing</strong>.</p>

<p class="wp-block-paragraph">Across all regional boards — Pune, Nashik, Chhatrapati Sambhajinagar, and Nagpur — MHADA has allotted <strong>41,500 tenements</strong> in the same timeframe.</p>



<p class="wp-block-paragraph">Additionally, nearly <strong>20,000 mill workers have already been allotted homes</strong>, and eligibility for <strong>around one lakh mill workers and their heirs</strong> has been finalized to speed up future allotments.</p>

<p class="wp-block-paragraph">The Supreme Court has underscored that courts cannot lightly condone extraordinary delays in restoring dismissed cases, especially when long gaps have allowed third-party rights to arise.</p>



<p class="wp-block-paragraph">The ruling came in a decades-old property dispute, where an appeal dismissed in <strong>2008</strong> for non-prosecution was restored by the Bombay High Court in <strong>2023</strong>—after an extraordinary <strong>14-year delay (5,250 days)</strong>. The developer, <strong>Sethia Infrastructure Pvt. Ltd.</strong>, who had since launched a major project on the land, challenged the restoration in the Supreme Court.</p>



<hr class="wp-block-separator has-alpha-channel-opacity"/>



<h2 class="wp-block-heading"><strong>Case Background</strong></h2>



<p class="wp-block-paragraph">The eviction suit dates back to <strong>1967</strong>. The trial court dismissed the suit in <strong>1988</strong>, and a first appeal was admitted in <strong>1989</strong>. In 2008, the High Court made it clear that if the appellants failed to file pleadings within three months, the appeal would be dismissed. Since they did not comply, the appeal stood <strong>dismissed on May 20, 2008</strong>.</p>



<p class="wp-block-paragraph">It was only in <strong>2022</strong> that the plaintiffs sought to restore the appeal. The Bombay High Court, in <strong>October 2023</strong>, condoned the 14-year delay and restored the case based merely on the applicants’ affidavit of service—without hearing the developer, who by then had acquired and redeveloped the property.</p>

<h2 class="wp-block-heading"><strong>Supreme Court’s Observations</strong></h2>



<p class="wp-block-paragraph">Setting aside the restoration, the bench observed:</p>



<ul class="wp-block-list">
<li><strong>Time does not stand still.</strong> After such long gaps, courts must presume that third-party interests are likely to have been created.</li>



<li>Delay condonation requires strong justification, and in this case, the High Court gave <strong>no reasons</strong> for allowing such an extraordinary delay.</li>



<li>The applicants had “<strong>woken up from their alleged slumber only when a developer had entered the picture and started construction</strong>.”</li>
</ul>



<p class="wp-block-paragraph">The Court stressed that condoning such long delays without considering third-party rights could cause serious injustice.</p>

<p class="wp-block-paragraph">The complainant, <strong>Pradeep Syntex Pvt. Ltd.</strong>, claimed rights to 10 flats based on agreements signed with the <strong>erstwhile developer</strong>, Samarth Krupa Developers, under a 2006 development pact. However, the society later terminated that agreement via arbitration in 2022 and appointed a new developer — <strong>M/s Priti Infra Builders</strong> — for the same project, now registered under MahaRERA as <em>Tagore Nagar Nandadeep CHS Ltd</em>.</p>



<p class="wp-block-paragraph">The complainant urged MahaRERA to:</p>



<ul class="wp-block-list">
<li>Recognize and enforce the original agreements,</li>



<li>Ensure allotment of flats,</li>



<li>And stop the new developer from selling flats from the “free sale” quota until the case was resolved.</li>
</ul>



<p class="wp-block-paragraph">But <strong>the complaint was dismissed</strong>, as MahaRERA held that:</p>

<li>The complainant <strong>failed to provide necessary documentation</strong>, including the lease deed and agreement for sale,</li>



<li>The society’s own registration details were missing,</li>



<li>And most critically, the <strong>relief sought does not fall under MahaRERA’s jurisdiction</strong>.</li>

<p class="wp-block-paragraph">“Parties have failed to provide agreement for sale… the redevelopment project and the relief sought by the complainant do not fall within the purview of RERA.”</p>

<p class="wp-block-paragraph">This effectively means that <strong>MahaRERA cannot enforce private agreements made with former developers</strong> unless they’re backed by proper documents and fall squarely under the Act’s provisions.</p>

<p class="wp-block-paragraph">The <strong>Maharashtra Real Estate Regulatory Authority (MahaRERA)</strong> has <strong>dismissed a complaint</strong> filed by <strong>Manish Rajput</strong> against <strong>Rajhans Realtors</strong> and <strong>Raja Rani Co-op Housing Society</strong> over alleged <strong>breaches in a redevelopment project</strong>. The authority ruled that the matter falls <strong>outside its jurisdiction</strong>, as <strong>redevelopment projects are not covered under RERA regulations</strong>.</p>



<h3 class="wp-block-heading"><strong>Background of the Case</strong></h3>



<p class="wp-block-paragraph">The dispute arose from a <strong>development agreement signed in April 2013</strong>, where Rajhans Realtors was entrusted with the <strong>redevelopment</strong> of the housing society’s property. Under the agreement:</p>

<li>The <strong>developer was to complete the project within 36 months</strong> and provide <strong>alternate accommodation</strong> to residents.</li>



<li>The <strong>complainant was entitled to a 675 sq. ft. flat</strong>, including an additional <strong>108 sq. ft. sale area</strong>.</li>



<li>The developer agreed to pay a <strong>monthly rent to members</strong> until the project was completed.</li>
</ul>



<p class="wp-block-paragraph">However, <strong>the project was delayed</strong>, and the complainant alleged that:</p>



<ul class="wp-block-list">
<li><strong>No rent was paid since June 2016</strong>, leading to financial hardship.</li>



<li><strong>The flat’s promised area was reduced</strong> without consent.</li>



<li>The society and developer engaged in <strong>unilateral negotiations</strong>, keeping members in the dark.</li>
</ul>

<li><strong>Redevelopment projects do not fall under MahaRERA’s jurisdiction</strong>, as they are <strong>not classified as real estate sales</strong>.</li>



<li>The <strong>Permanent Alternate Accommodation Agreement (PAAA)</strong> signed between the parties does <strong>not qualify as an Agreement for Sale</strong>, making the dispute <strong>outside RERA’s scope</strong>.</li>



<li><strong>Termination of the Development Agreement</strong> is a matter for <strong>civil courts</strong>, not MahaRERA.</li>
</ul>



<h3 class="wp-block-heading"><strong>Impact and Next Steps</strong></h3>



<p class="wp-block-paragraph">The ruling highlights <strong>limitations in RERA’s coverage</strong>, particularly in <strong>redevelopment projects</strong>, where homebuyers must <strong>seek relief in civil courts</strong> rather than through MahaRERA. The company has named <strong>Nishikant Shimpi</strong> as Chief Executive Officer (CEO) and <strong>Anand Chirania</strong> as Chief Financial Officer (CFO), effective immediately. These appointments were approved by the company’s board today, signaling its commitment to building a strong leadership team as it seeks to scale up operations.</p>



<p class="wp-block-paragraph"><strong>Expansion and Leadership Strengthening</strong></p>



<p class="wp-block-paragraph">B-Right RealEstate, which currently has over 36 lakh square feet of projects under development, is in the midst of a strategic transition from focusing primarily on Slum Rehabilitation Authority (SRA) projects to diversifying into redevelopment projects. The company aims to capitalize on the growing opportunities in Mumbai’s real estate market, particularly in the western suburbs from Borivali to Bandra, where many of its residential and commercial developments are located.</p>

A Civil Engineering graduate with a Master’s in Management Studies from Sydenham Institute, Shimpi has held leadership roles across major real estate companies. His previous positions include CEO of Inspira Realty, CEO of Pashmina Realty, and SBU Head at L&T Realty, among others. He also led Godrej Properties’ expansion into South India in 2005 and managed a 720-acre project in Lagos, Nigeria.</p>



<p class="wp-block-paragraph">Shimpi is known for his innovative approach, having implemented India’s first Automated Prepaid Reticulated Gas System in 2009 and pioneered a real-time software platform for NRI realty customers. At B-Right, he will lead operations and oversee the company’s growth strategy.</p>



<p class="wp-block-paragraph"><strong>Anand Chirania: Financial Expertise to Drive Growth</strong></p>



<p class="wp-block-paragraph">Anand Chirania, who will serve as CFO, brings over 23 years of financial and corporate management experience. A Chartered Accountant with an MBA in Finance from Narsee Monjee College, Chirania has handled various roles involving debt and equity financing, including managing corporate finance at Godrej Properties and heading the Merchant Banking Division at Anand Rathi.</p>



<p class="wp-block-paragraph">During his career, Chirania has successfully managed funds worth over Rs. 1,500 crore, generating an impressive 21%+ internal rate of return (IRR) for stakeholders. He also played a key role in raising approximately Rs. 7,000 crore through IPOs, private equity, and family office funding. He succeeds Jinal Mukeshkumar Mehta, who will continue as Head of Accounts & Compliance.</p>



<p class="wp-block-paragraph"><strong>B-Right’s Growth Trajectory</strong></p>



<p class="wp-block-paragraph">In recent months, B-Right has shifted its focus from solely executing SRA projects to embracing the broader opportunities within Mumbai’s redevelopment market. With a Gross Development Value (GDV) of nearly Rs. 6,000 crore across more than 20 residential and commercial projects, the company is positioning itself to play a significant role in the city’s real estate landscape.</p>



<p class="wp-block-paragraph">B-Right has shown impressive financial growth, with revenues rising 119% to Rs. 42.28 crore in FY24, compared to the previous fiscal year. The company also reported an EBITDA of Rs. 11.20 crore, up 91% from FY23. These figures highlight B-Right’s increasing profitability and the successful execution of its business strategies.</p>



<p class="wp-block-paragraph">Founded in 2008 by Sanjay Shah, B-Right RealEstate is an integrated construction and real estate development company that primarily focuses on residential and commercial projects in and around Mumbai. The company went public in July 2022 with a successful IPO on BSE’s SME platform.</p>
