No More Jail for Homebuyers – RERA Section 68 Rewritten

In a landmark relief for homebuyers, the Ministry of Housing and Urban Affairs has enforced the amendment to RERA Section 68 effective 7 May 2026. The provision for up to one year’s imprisonment has been completely removed and replaced with a civil penalty of up to 10% of the property cost. The change is part of the Jan Vishwas (Amendment of Provisions) Act, 2026.

Builder Fined by RERA for “Coming Soon” Ads

The Bihar RERA has fined a developer ₹1 lakh for displaying “Coming Soon” posters and online ads for an unregistered project, holding that even minimal promotions violate Section 3 of the RERA Act and defeat buyer protection goals.

Even Unregistered Allotment Letters Before RERA Hold Value If Money Was Paid and Flats Promised

MahaRERA’s latest order states that even pre-RERA allotment letters are valid proof of flat booking if money was paid and possession was promised. AAP Realtors and Samta Builders have been ordered to refund or allot alternate flats in the Tirumala Habitats project, with a ₹1 lakh penalty for non-disclosure.
