In a victory for elderly rights, the Delhi High Court has affirmed that “love and affection” in a property gift deed to a family member is an implied condition of care. If the transferee fails to provide basic amenities and support, the senior citizen can reclaim their property by declaring the transfer void under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.
