<p>In a case that sheds light on inter-developer disputes affecting Mumbai homebuyers, the <strong>Maharashtra Real Estate Regulatory Authority (MahaRERA)</strong> has restored a complaint against <strong>Shapoorji Pallonji Real Estate</strong> after the complainant alleged that the <strong>Olympia C D project in Mulund</strong> remained a non-starter due to disagreements between <strong>Shapoorji Pallonji</strong> and <strong>Nirmal Lifestyle Pvt. Ltd.</strong></p>

<p>The complainant, <strong>Arun Nishad</strong>, had booked <strong>Flat No. 1601 in Tower D</strong> of the <em>Olympia </em> project and claimed to have paid <strong>more than 10% of the flat’s consideration amount</strong>. He sought a <strong>refund along with interest</strong> under <strong>Section 18 of the RERA Act</strong>, citing the developer’s failure to commence construction.</p>



<p>The complaint, filed originally in <strong>October 2022</strong>, was dismissed earlier in <strong>March 2025</strong> after Nishad remained absent for two consecutive hearings.</p>

<p>In <strong>September 2025</strong>, the complainant filed a <strong>restoration application</strong>, explaining that <strong>technical glitches</strong> had prevented his participation in earlier hearings.</p>



<p>Hearing the plea on <strong>October 28, 2025</strong>, MahaRERA Member <strong>Mahesh Pathak</strong> allowed the restoration, citing principles of natural justice. The regulator noted that despite being notified, <strong>no one from Shapoorji Pallonji Real Estate appeared</strong> during the hearing or filed any response opposing the restoration.</p>

<p>MahaRERA has now:</p>

<li><strong>Restored the original complaint</strong> to its previous stage.</li>



<li>Directed <strong>Shapoorji Pallonji Real Estate</strong> to file its <strong>reply within three weeks (by November 18, 2025)</strong>.</li>



<li>Allowed the complainant time till <strong>December 9, 2025</strong>, to file his <strong>rejoinder</strong>.</li>



<li>Scheduled the <strong>final hearing for December 23, 2025</strong>.</li>



<li>Instructed the Registry to <strong>verify the project’s “kept in abeyance” status</strong> with the registration department.</li>

<p>The <strong>Olympia C D</strong> project, located on <strong>LBS Road, Mulund (West)</strong>, was registered by <strong>Shapoorji Pallonji Real Estate</strong>.<br>However, as per multiple buyer complaints, the project has been <strong>stalled due to disputes</strong> between the developer and <strong>Nirmal Lifestyle Pvt. Ltd.</strong>, the original landowner and development partner. The delay has left several homebuyers awaiting clarity and refunds.</p>

<p>The order emphasizes that <strong>MahaRERA continues to uphold procedural fairness</strong> — ensuring that even dismissed cases can be revived when valid technical or procedural issues are demonstrated.</p>
