<p>The Bombay High Court has restrained new developers from carrying out construction on a CIDCO-allotted plot in <strong>Ulwe, Navi Mumbai</strong>, after holding that earlier developers who had invested over <strong>₹3.12 crore</strong> in the project deserved interim protection.</p>



<p>Justice <strong>Milind N. Jadhav</strong>, while allowing <strong>Appeal From Order No. 479 of 2025</strong>, set aside a trial court order and granted a temporary injunction in favour of <strong>Sunil Narayan Patil and partners of Anita Developers</strong>, who are seeking specific performance of development agreements executed more than a decade ago.</p>

<h3 class="wp-block-heading"><strong>The Ulwe Plot and the Original Allotment</strong></h3>



<p>The dispute centres around <strong>Plot No. 37 (earlier Plot No. 57)</strong> located at <strong>Sector 9, Ulwe, Panvel, Raigad district</strong>, earmarked for allotment by <strong>CIDCO</strong> under the State Government’s <strong>12.5% land compensation scheme</strong>.</p>



<p>In <strong>December 2007</strong>, CIDCO issued a <strong>Letter of Intent</strong> in favour of a group of original landowners led by <strong>Pundalik Balaji Gharat</strong>, along with other members of the Gharat family.</p>

<h3 class="wp-block-heading"><strong>Early Agreements and Entry of Developers</strong></h3>



<p>In <strong>February 2010</strong>, the landowners entered into an agreement with <strong>Ashok Patil and Ramesh Patil</strong>, granting them authority to deal with and develop the proposed CIDCO plot for a consideration of <strong>₹2.25 crore</strong>.</p>



<p>Subsequently, on <strong>26 February 2013</strong>, Ashok Patil and Ramesh Patil executed a <strong>Memorandum of Understanding (MOU)</strong> with <strong>Anita Developers</strong>, a partnership firm represented by <strong>Sunil Narayan Patil and others</strong>.</p>



<p>As per court records, between <strong>2013 and 2020</strong>, Anita Developers paid approximately <strong>₹3.12 crore</strong> to the original landowners and their legal heirs through banking channels.</p>

<h3 class="wp-block-heading"><strong>CIDCO Lease and New Developers Enter the Scene</strong></h3>



<p>CIDCO eventually executed a <strong>lease deed in November 2022</strong> in favour of the original landowners.</p>



<p>In <strong>April 2023</strong>, the landowners entered into a <strong>tripartite agreement</strong> with CIDCO and a new set of developers — <strong>Shree Sai Developers</strong>, represented by <strong>Mahesh Patil and Suresh Patil</strong> — who claimed development rights and began construction activity on the Ulwe plot.</p>



<p>This prompted Anita Developers to file <strong>Special Civil Suit No. 93 of 2024</strong> in the Panvel civil court, seeking specific performance of the earlier agreements and an injunction against further development.</p>



<hr class="wp-block-separator has-alpha-channel-opacity"/>



<h3 class="wp-block-heading"><strong>Trial Court Refuses Relief</strong></h3>



<p>The trial court refused to grant interim relief, holding that the 2013 MOU in favour of Anita Developers was not signed directly by the original landowners and therefore did not create enforceable rights.</p>



<p>Challenging this finding, Anita Developers approached the Bombay High Court.</p>

<h3 class="wp-block-heading"><strong>High Court: Payments and Conduct Cannot Be Ignored</strong></h3>



<p>Allowing the appeal, Justice Jadhav observed that:</p>



<ul class="wp-block-list">
<li><strong>₹3.12 crore had indisputably been paid</strong> by Anita Developers to the landowners and their legal heirs</li>



<li>The landowners <strong>did not deny receipt of money</strong>, and several of them chose not to contest the proceedings</li>



<li>Ashok Patil and Ramesh Patil <strong>admitted execution of the agreements and receipt of consideration</strong></li>
</ul>



<p>The Court noted that the 2010 agreement expressly authorised Ashok Patil and Ramesh Patil to <strong>create third-party rights</strong>, under which the 2013 MOU with Anita Developers was executed.</p>

<h3 class="wp-block-heading"><strong>New Developers Failed Due Diligence</strong></h3>



<p>The High Court was critical of <strong>Shree Sai Developers</strong>, holding that they failed to carry out <strong>basic due diligence</strong> before entering into the 2023 tripartite agreement.</p>



<p>The Court ruled that the new developers could not claim the status of <strong>bona fide purchasers</strong>, especially when substantial payments, agreements, and long-standing claims existed in favour of Anita Developers.</p>

<h3 class="wp-block-heading"><strong>Injunction Granted</strong></h3>



<p>Holding that all parameters for interim relief were satisfied, the High Court:</p>



<ul class="wp-block-list">
<li><strong>Set aside the Panvel trial court order dated 13 June 2025</strong></li>



<li>Granted a <strong>temporary injunction</strong></li>



<li>Directed all parties to <strong>maintain status quo</strong></li>



<li>Restrained Shree Sai Developers from <strong>developing, selling, or creating third-party rights</strong> on the Ulwe plot until final disposal of the suit</li>
</ul>

<p>With the completion of pressure conduit work under CIDCO’s Hetavane Water Supply Scheme, it will be now possible to supply an additional 30 MLD of water to Navi Mumbai through Hetavane Water Supply Scheme. This has helped in streamlining the water supply to the nodes under CIDCO jurisdiction.</p>



<p>“Various measures are being taken by CIDCO to ensure smooth water supply in nodes under CIDCO jurisdiction. An additional 30 MLD water has been immediately made available from the Hatavane Dam, as CIDCO completed work of the pressure conduit in the record time of 15 days. This has definitely brought relief to the citizens as the water supply in the nodes under CIDCO’s jurisdiction has been improved. Apart from this, discussions are going on with Navi Mumbai Municipal Corporation, MIDC and Maharashtra Jeevan Pradhikaran to resolve the water issue.” Dr. Sanjay Mukherjee, Vice Chairman and Managing Director, CIDCO.</p>



<p>Water is supplied by CIDCO to Kharghar, Ulwe, Taloja, Dronagiri, JNPT Port, Dighode MIDC area from Hetwane Water Supply Scheme. Due to the development of various projects & mega housing schemes being undertaken by CIDCO in South Navi Mumbai citizens are now giving priority to these nodes for living. The demand for water is also increasing day by day due to the growing population in this node.</p>



<p>Water is being supplied in these nodes under CIDCO administered area through Hetavane Dam, NMMC’s Morbe Dam, MJP’s Palatganga source, Nhava- Shevha Scheme, and MIDC’s Barvi dam. The water demand for CIDCO jurisdiction area was 289 MLD but, CIDCO was getting only 259 MLD at the supply point with a shortfall of 30 MLD. Various short and long-term plans are being implemented by CIDCO to meet the growing water demand.</p>



<p>The Hetavane Water Supply Scheme which is the most important source of water supply, provides 150 MLD of water to CIDCO. CIDCO has obtained an additional quota of 120 MLD from Heatvane Dam which is sanctioned by the GoM Water Resource Department. In order to use the additional 120 MLD water storage, it is necessary to augment the existing Hetavane Scheme to 270 MLD which will require a time duration of 5 years.</p>



<p>However, to address the current water shortage, M/ s. Tata Consulting Engineers Ltd.  (TCE) has been appointed by CIDCO as an expert consultant to explore the possibility of utilizing the available water resource and the recently completed underground micro tunneling as well as existing water supply infrastructure. TCE has been entrusted with the task of preparing a water augmentation plan for the maximum drawl of water from the Hetavane scheme. </p>



<p>In order to expedite the extraction of an additional 30 MLD of water, TCE recommended a long-closed pressure conduit instead of the existing open channel outlet. Accordingly, CIDCO has decided to connect the Hetavane Irrigation Canal Power Outlet (ICPO) to CIDCO’s water supply system through a pressure conduit. The design was prepared by CIDCO and received approval from Central Design Organisation (CDO), Nashik, and Water Resource Department (WRD), GoM. CIDCO has completed the work of the pressure conduit in a record time of 15 days and the pressure conduit is now operational since 6th June 2022. So it is now possible to draw additional 30 MLD water from Hetavane Water Supply Scheme.</p>



<p>The additional 30 MLD water reserves will help in streamlining the water supply in Kharghar, Taloja, Dronagiri, JNPT Port, and Dighode MIDC.</p>

<p>CIDCO will send a proposal to the state government to give the land at Ulwe to the Tirupati Devasthan for the temple</p>

<p>The decision to submit a proposal for allotment of land for the temple at Ulwe in Navi Mumbai to the world famous Tirupati Tirumala Devasthan has been taken at a meeting of the Board of Directors of CIDCO.</p>



<p>The land will be allotted for the construction of a temple by the Tirupati Tirumala Devasthanam to make it easier for devotees in Maharashtra to take darshan of Shri Venkateswara.</p>



<p>Urban Development Minister Eknath Shinde, and Tourism Minister Aditya Thackeray had instructed CIDCO to send the proposal to the Government for approval with the approval of the Board of CIDCO.</p>



<p>It is not possible for everyone to visit Tirupati in Andhra Pradesh to pay homage to lord Venkateswara. For such devotees in Maharashtra and especially in Mumbai Metropolitan Region, The Shri. Tirupati Tirumala Devasthan was repeatedly requesting the state government to build a temple for Lord Venkateswara.</p>

<p>In this connection, Tirumala Tirupati Devasthan President Subba Reddy wrote a letter on 27 February 2022 requesting approval for construction of a temple near Navi Mumbai International Airport, which is being constructed in Navi Mumbai. After which, Chief Minister Uddhav Thackeray had instructed <a href="https://twitter.com/CIDCO_Ltd/status/1510224385948676101?s=20&t=qPIYlorntVO7dO9NpHow_w" target="_blank" rel="noreferrer noopener">CIDCO</a> to take action.</p>



<p>Subba Reddy, President, Tirumala Tirupati Devasthan, Dharma Reddy, Additional Chief Officer, Tirumala Tirupati Devasthan, Trinamool Tirupati Devasthan Trustee Milind Narvekar and Saurabh Bora actually inspected the available plots in Navi Mumbai. After that, in the meeting held at Varsha, it was discussed to choose a suitable plot for the temple from the available options.</p>

<p>Accordingly, the land in Ulwe Node, which is close to the upcoming international airport and has good connectivity with the cities around Navi Mumbai, has been identified. Approximately 10 acres of land will be allotted to the Tirupati Tirumala Devasathan.</p>



<p>The plot is part of a plot allotted by CIDCO to the Mumbai Metropolitan Region Development Authority (MMRDA) on a live and license basis for a casting yard under the MTHL project. At the request of CIDCO, MMRDA has approved the re-possession of the allotted land to CIDCO. The plot will be acquired by CIDCO in phases from March to September 2023.</p>
