<p>The Bombay High Court has granted <strong>interim protection</strong> to a Worli-based family living in Mumbai’s iconic BDD Chawl redevelopment precinct, after observing that a tenement recorded on paper as a <em>“common bathroom”</em> has, in reality, been used as a <strong>residential home for nearly four decades</strong>.</p>



<p>In an order passed on <strong>Wednesday, December 17, 2025</strong>, a Division Bench of <strong>Justice G.S. Kulkarni and Justice Aarti Sathe</strong> directed that <strong>no coercive action be taken</strong> against the petitioners until the matter is heard further, while also ordering a <strong>court-supervised site inspection</strong> to verify the actual nature of the premises.</p>



<h3 class="wp-block-heading"><strong>The dispute: A ‘bathroom’ that became a home</strong></h3>



<p>The petition has been filed by <strong>Malan Baburao Beekar</strong>, widow of the late Baburao Beekar, along with another family member, who claim to be in occupation of <strong>Room No. 81, Chawl No. 18, BDD Chawl, NM Joshi Marg, Worli</strong>, since <strong>1986</strong>.</p>



<p>According to the petitioners, although the room is shown in official records and redevelopment plans as a <em>common bathroom</em>, it has been <strong>used and recognised as a residential tenement for decades</strong>. The family argues that while <strong>other BDD Chawl occupants are being granted permanent alternate accommodation (PAA)</strong> under the ongoing redevelopment, they are being excluded solely because of this technical classification.</p>



<p>Their core grievance: <strong>long-standing occupation is being ignored in favour of outdated paper records</strong>.</p>



<h3 class="wp-block-heading"><strong>High Court finds “prima facie substance”</strong></h3>



<p>After perusing the record, the Bench noted that there appears to be <strong>prima facie merit</strong> in the petitioners’ case.</p>



<p>The court made a strong observation, calling it a <em>“sad reality”</em> that even premises marked as common bathrooms were <strong>permitted to be used and recognised as homes for several years</strong>. It further remarked that <strong>if such long-term occupation is established</strong>, occupants of these premises <strong>cannot be treated differently</strong> from other residents during redevelopment.</p>



<p>Importantly, the court has <strong>not yet decided the issue finally</strong>, but has clearly indicated that the petitioners’ claim warrants serious examination.</p>



<h3 class="wp-block-heading"><strong>Court orders site inspection, seeks MHADA’s stand</strong></h3>



<p>To ascertain the factual position, the High Court has directed a <strong>Court Officer, appointed by the Prothonotary and Senior Master</strong>, to <strong>visit the premises</strong>, verify whether it is being used as a residential unit and submit a report along with photographs.</p>



<p>The inspection is to take place in the presence of <strong>MHADA representatives</strong>, with the report to be filed before the court ahead of the next hearing on <strong>December 22, 2025</strong>.</p>



<p>The State government and MHADA have also been asked to file an <strong>affidavit clarifying their stand</strong> on whether occupants of such tenements are eligible for permanent alternate accommodation.</p>



<p>Till then, the court has categorically ordered that <strong>no eviction or coercive steps</strong> be taken against the petitioners.</p>



<h3 class="wp-block-heading"><strong>Context: BDD Chawl redevelopment by MHADA</strong></h3>



<p>The order comes amid the massive <strong>BDD Chawl redevelopment project being undertaken by MHADA</strong>, covering three major clusters — <strong>Worli, Naigaon and NM Joshi Marg</strong> — together comprising <strong>over 200 chawl buildings</strong>.</p>



<p>The project, one of Mumbai’s largest redevelopment exercises, aims to rehouse thousands of old chawl residents into modern apartment buildings while freeing up valuable land parcels in central Mumbai.</p>



<p>However, the present case highlights a <strong>grey area in redevelopment policy</strong>: how authorities should treat <strong>non-standard or irregular tenements</strong> that evolved over decades but were never formally regularised in official layouts.</p>



<h3 class="wp-block-heading"><strong>A brief history of BDD Chawls</strong></h3>



<p>Constructed in the <strong>1920s by the Bombay Development Directorate (BDD)</strong> during the British era, the BDD Chawls were originally built to house mill workers and low-income residents close to Mumbai’s industrial hubs.</p>



<p>Over the decades, these chawls became <strong>deeply entrenched residential communities</strong>, often adapting informally to population pressures — including the conversion of storage spaces and common utilities into living quarters.</p>



<p>The current redevelopment is meant to modernise this ageing housing stock, but cases like this underline the <strong>social and legal complexities</strong> involved when lived reality clashes with planning records.</p>



<h3 class="wp-block-heading"><strong>What lies ahead</strong></h3>



<p>While the High Court’s order does <strong>not grant permanent rehabilitation yet</strong>, it sends a strong signal that <strong>technical labels alone cannot override decades of occupation</strong>.</p>



<p>The outcome of the site inspection and MHADA’s response could have <strong>wider implications</strong>, potentially affecting how similar cases are treated across the BDD Chawl redevelopment and other large housing renewal projects in Mumbai.</p>



<p>For now, the petitioners have secured <strong>breathing space — and judicial attention — in a process where many fear being left behind</strong>.</p>

<p><em>Government invites objections for proposed modification to Development Plan 2034; MMRDA to plan commercial redevelopment of the iconic Worli Dairy land</em></p>



<h3 class="wp-block-heading"><img src="https://s.w.org/images/core/emoji/17.0.2/72x72/1f3d9.png" alt="🏙" class="wp-smiley" style="height: 1em; max-height: 1em;" /> <strong>Government Issues Notice to Change Land Use</strong></h3>



<p>The Government of Maharashtra has officially proposed to <strong>delete the reservation for a “Marine Research Institute, Aquarium and Exhibition Center”</strong> on the Worli Dairy land and <strong>include the plot in the Commercial Zone</strong>, paving the way for its redevelopment into a commercial hub.</p>



<p>This proposed modification has been issued under <strong>Section 37(1AA) of the Maharashtra Regional and Town Planning Act, 1966</strong> and was published on <strong>25 September 2025</strong> by the <strong>Urban Development Department</strong>. The notice invites <strong>public objections and suggestions within one month</strong> from its publication.</p>

<p>The land in question — spread over <strong>6.40 hectares</strong> — lies in <strong>Worli Division</strong>, a prime central Mumbai location. Under the <strong>Development Plan 2034</strong>, the plot was earlier marked as a <strong>“Dairy” (EP4.1)</strong> and zoned as a <strong>Residential Zone</strong>.</p>



<p>Later, in <strong>2022</strong>, the government modified this to reserve:</p>



<ul class="wp-block-list">
<li>A portion of the land for a <strong>Marine Research Institute, Aquarium and Exhibition Center</strong></li>



<li>The remaining for <strong>Government Offices</strong></li>
</ul>



<p>This vision, however, is now being replaced by a <strong>commercial land use plan</strong>.</p>

<p>The shift towards commercial development follows a proposal by the <strong>Mumbai Metropolitan Region Development Authority (MMRDA)</strong> in <strong>January 2024</strong>, in which it highlighted that:</p>



<ul class="wp-block-list">
<li>The <strong>Worli Dairy land is centrally located</strong>, making it ideal for a <strong>planned commercial and mixed-use development</strong>.</li>



<li>Such development could generate <strong>new employment opportunities</strong> and contribute to Mumbai’s economic growth.</li>



<li>MMRDA requested the <strong>handover of the land</strong> and to be appointed as the <strong>Special Planning Authority (SPA)</strong> for the site.</li>
</ul>



<p>Subsequently, in a <strong>Growth Hub Governing Council meeting</strong> chaired by the <strong>Chief Minister on 7 April 2025</strong>, it was decided to appoint <strong>MMRDA as the Project Implementing Agency</strong>. MMRDA will now prepare a <strong>Draft Planning Proposal</strong> for the site and submit it to the state government for sanction.</p>

<li>Citizens and stakeholders can submit their views <strong>within one month</strong> from the date of publication of the notice in the <strong>Maharashtra Government Gazette</strong>.</li>



<li>Submissions should be made to the <strong>Deputy Director of Town Planning, Greater Mumbai</strong>, at Azad Maidan.</li>

<p>Redevelopment of Worli Koliwada became the centre point of discussion in the village where a hoarding against the public notice came up.</p>

<p>While entering Worli Koliwada a huge poster greets you. The poster has in red Jahir Nisedh written in Marathi, which means public protest.</p>



<p>The poster has a picture of the public notice that was issued last week. The content of the public notice read Worli Koliwada Owners Community Welfare Co-Operative Society Ltd, a society registered under the provisions of Maharashtra Co-operative Societies Act, 1960 represented by 457 owners of the land within Worli Koliwada, the entire land is inclusive of Owner’s land, land pertaining to Navy and Coast Guard, Foreshore land, Open and enclosed drainage, authorised and unauthorised slums, heritage buffer area, social and public infrastructure standing thereon which are not explicitly mentioned are collectively referred to as the said property.</p>



<p>The notice further read, Worli Koliwada Owners Community Welfare Cooperative Society ltd represented by majority of its owners are in the process of concluding the negotiations for the grand of the development right to MDM realty group as the potential developer for the redevelopment of the property.</p>



<p>The new poster that has come out near Chede Dev Mandir and at the Hanuman Mandir inside the Koliwada raised a total of six points.</p>



<p>This poster has been issued by Hira Kapar Patil Jamat, Gavkari Koli Jamat and Panch, Manik Dharma Patil Jamat Trust and Manik Dharma Patil Grihnirman Sansatha Ltd.</p>



<p>The first point in the poster is a question to the residents of the village, &#8220;Have you transferred your house / property rights as per the public notice issued in newspaper dated March 16, 2022?</p>



<p>The second point is, &#8220;Have you given the right to develop your home / property to someone else?&#8221;</p>



<p>The third point is, &#8220;Does anyone who decided to develop have the potential to develop their entire Koliwada? And have you checked it?&#8221;</p>



<p>The next point is asking citizens, &#8220;Is it appropriate to give a public notice without giving you any idea or trust?&#8221;</p>



<p>The other point in the banner is, &#8220;If being an owner you haven&#8217;t given any rights for the redevelopment of your property to any other person then is right to keep quiet?&#8221;</p>



<p>The last point states, that the three Jamat who have come out with the poster have raised their objection for the public notice issued for the redevelopment.</p>



<p>On Friday there was a meeting held by the residents associated with the these jamats. Many residents of Worli Koliwada are sending their objection against the notice. </p>



<p>More meeting against the public notice are expected to take place in the village. Residents allege that they were not taken into confidence before the issuance of the public notice.</p>

<p>Koliwada spread over 65 acres of land came out with a public notice on Wednesday which was meant for title investigation of the land where the Koliwada is situated.</p>



<p>The notice read Worli Koliwada Owners Community Welfare Co-Operative Society Ltd, a society registered under the provisions of Maharashtra Co-operative Societies Act, 1960 represented by 457 owners of the land within Worli Koliwada, the entire land is inclusive of Owner&#8217;s land, land pertaining to Navy and Coast Guard, Foreshore land, Open and enclosed drainage, authorised and unauthorised slums, heritage buffer area, social and public infrastructure standing thereon which are not explicitly mentioned are collectively referred to as the said property.</p>

<p>When contacted Prahlad Worlikar, Secretary of the Society, he confirmed that the notice was issued and it was for land title investigation. He further confirmed that negotiations for the redevelopment are going on with MDM realty group.</p>



<p>However, many residents of Worli Koliwada were unaware, one of the resident said that they have been hearing about redevelopment for quite some time but wasn&#8217;t aware about any such public notice being issued. Most residents are happy with the news, but expect that they be rehabilitated in a proper manner.</p>



<p>A few years ago according to a <a href="https://www.dnaindia.com/mumbai/report-worli-koliwada-has-its-own-development-plan-2616626" target="_blank" rel="noreferrer noopener">report by this reporter for DNA Newspaper,</a> the Kolis had prepared a plan for the redevelopment of the koliwada. The plan proposes high rises with 1,000-sq ft homes, or 3BHKs, for original residents and 400 sq ft flats for tenants. It base of the redevelopment was on Development Control Rule 33 (9), which will allow them to get an FSI of 4 where, currently, they get 1.5 to 2. The Kolis had also planned a sea-facing mall, which they would lease out to generate revenue.</p>



<p>However, when asked Prahlad Worlikar whether the same plan is being implemented, he said, &#8220;Currently we are only negotiating with the developer, nothing else has been finalised, this notice is only for land title investigation, any thing else will be decided by taking a sabha by seeking everyone&#8217;s consent.&#8221;</p>



<p>Everyone in Koliwada wants an upgrade, whether for their houses, approach roads or other amenities. The bylanes are so cramped that one cannot expect to take a four wheeler inside during day time. Water gets accumulated during monsoon and many other issues, The homes for many are too small as family grew and the expectation is that redevelopment will change the face of Koliwada and also solve the problems that they face.</p>
