Builder cancelled the booking of a home buyer. The home buyer alleged that the cancellation was unilateral.

The home buyer approached Maharashtra Real Estate Regulatory Authority (MahaRERA) seeking remedy.

MahaRERA finally ordered that the builder should refund the amount paid by the home buyer,

MahaRERA also asked the builder to pay interest to the home buyer. Mind it, the builder didn’t appear for the hearing.

Sandeep Dhumal, a home buyer approached MahaRERA against the builder Gera Developers Pvt Ltd.

The home buyer’s complaint was that he had paid a substantial amount till date to the builder for his booking.

However, one fine day he received an email from the developer cancelling his booking and the amount paid was forfeited.

The home buyer termed the cancellation as unilateral and was seeking remedy from MahaRERA against the builder.

The developer had failed to appear before MahaRERA in spite of he being served notice.

MahaRERA decided to pursue the matter exparte against the developer and proceeded.

The home buyer via his advocate informed MahaRERA that he would stay outdoors, and hence he couldn’t respond to the emails and demands of the builder.

However, he also submitted to MahaRERA that he shall be happy if the amount he has paid is refunded along with interest.

B D Kapadnis, MahaRERA, member who was hearing the case stated that as the developer has cancelled the booking he should refund the amount.

MahaRERA also ordered that the developer will pay an interest on the amount to be refunded from the date of receipt till refund.

The amount to be refunded is Rs 6.60 lakh. The prescribed interest rate is 2% above the Marginal Cost of funds based Lending Rate (MCLR) which is at 8.2%.
