MahaRERA has come out with a new order where secretary, MahaRERA can additionally deal with non-compliance applications. The order was issued on November 24.

Maharashtra Real Estate Regulatory Authority (MahaRERA), has come out with a new order on November 24.

The order states that, many application has been filed in MahaRERA on the ground of noncompliance of the orders passed by MahaRERA and Adjudicating officers.

The Authority in order to devote quality time for final disposal of a large number of pending complaints, felt it necessary to delegate the powers to deal with non compliance applications under section 40 (1) of the ACT, additionally, to the secretary, MahaRERA.

As per this order the secretary can additionally deal with non compliance applications in accordance with law.

There are large number of cases that MahaRERA is dealing on a regular basis. Till date the authority has receved a total of 12632 complaints of which it has passed orders in 8700 complaints.

The authority has received 27320 application for project registration of which 27,124 projcets were granted permissions an 6239 projcts have been completed.

The order is of delegation of powers to the secretary in case of failure to comply with orders of interest or penalty or compensation imposed by the authority or the adjudicating officers.

“This order will benefit the homebuyers to achieve the last mile benefit of the orders passed by the authority.”

According to Adv Prakkash Rohira this move will help a lot of homebuyers especially in those cases where the order has come in favour of the homebuyer but the developer isn’t complying with.
